In the Draft Proposal, the Ministry of Home Affairs has clearly stated the reasons and necessity for issuing the Decree amending and supplementing certain provisions of Decree 116/2010/ND-CP on policies for officials and public employees and salaried individuals in the armed forces working in areas with particularly difficult socio-economic conditions (hereinafter referred to as the Draft Decree).
At the Draft Decree, the Ministry of Home Affairs proposes to adjust three contents in 3 Articles of Decree 116/2010/ND-CP, including: Scope of adjustment; Principles of application and Initial allowance and relocation allowance. To be specific:
Regarding the scope of application stated in Article 1 of Decree 116, the Draft amends the content of point b, Clause 2, Article 1 to: “Particularly disadvantaged communes in ethnic minority and mountainous areas, particularly disadvantaged communes in coastal sand dunes and island areas are commune areas III according to the decision of the Prime Minister of the Government of Vietnam” to comply with current regulations.
Regarding the principle of application, the Draft Decree adds a regulation: In cases where more than 50% of the actual working time is in areas with particularly difficult socio-economic conditions, the policy stipulated in Decree 116/2010/ND-CP applies.
The initial allowance and relocation allowance are paid immediately when officials and public employees arrive to assume their duties in areas with particularly difficult socio-economic conditions and are only received once throughout their tenure in these particularly difficult socio-economic areas. In cases where officials and public employees do not meet the specified duration of work in particularly difficult socio-economic areas, the initial allowance and relocation allowance must be refunded.
As stated in the Draft Decree, the Ministry of Labor, Invalids and Social Affairs is responsible for submitting to the Prime Minister of the Government of Vietnam a Decision approving the list of particularly disadvantaged communes in coastal, island areas; the Committee for Ethnic Minorities is responsible for submitting to the Prime Minister of the Government of Vietnam a Decision approving the list of particularly disadvantaged communes in ethnic minority and mountainous areas.
Currently, the Draft Decree is collecting feedback to improve it further, and it is expected to come into effect in 2017.
