The Government has just issued Decree 115/2021/ND-CP amending and supplementing the process and procedures for election, resignation, relief from duty, removal from office, assignment and dismissal of members of the People's Committee. Accordingly, from December 16, 2021, the procedure for approving the results of the election of the Chairman and Vice Chairman of the People's Committee has some changes, specifically as follows:

Dossier to approve the results of election of the Chairman and Vice Chairman of the People's Committee
Clause 2, Article 1 of Decree No. 115/2021/ND-CP supplements the dossier of approval of the results of election of the Chairman and Vice Chairman of the People's Committee, including:
- The report of the Standing Committee of the People's Council (enclosed with the curriculum vitae of the person requested for approval);
- Resolution of the People's Council certifying the election results of the President and Vice Chairman of the People's Committee (enclosed with the minutes of vote counting results of the election of the President and Vice President of the People's Committee);
- A copy of the decision of the agency competent to approve the planning on the title of Chairman, Vice Chairman of the People's Committee of the person nominated for election for the first time;
- A copy of the decision or written notice of opinions on the nominated personnel of the competent agency according to the staff management hierarchy (enclosed with a summary of the vote counting results and the minutes of vote counting at each step). in the HR process);
- Curriculum vitae according to the current form according to the guidance of the Central Organization Department, confirmed by the official and the agency directly managing the staff member, certified and stamped according to regulations (with a 4x6 color photo, taken in time not exceeding 06 months);
- A declaration of assets and personal income of the person requested for approval according to the current form prescribed by the Government and guided by the Government Inspector;
- Conclusion on political standards as prescribed;
- A copy of the most recent decision on assignment, transfer, rotation and discipline of the officer (if any);
- Comments and evaluation of cadres of the Party Committee according to the cadre management decentralization (within the last 3 years), of the Party Committee of the place of residence, the Party cell and the Party committee of the agency where they work (within 06 months) ;
- Copies of diplomas and certificates as required by standards for elected titles. In case the employee has a diploma issued by a foreign educational institution, it must be recognized in Vietnam according to regulations;
- Health certificate from a competent medical facility (within 06 months).

Procedures for approving the results of election of the Chairman and Vice Chairman of the People's Committee
- Within 05 working days from the date of receipt of 02 complete sets of dossiers as prescribed, the appraising agency must consider and appraise the dossiers for approval of the results of election of the Chairman and Vice Chairman of the People's Committee. .

In case the dossier is missing or has errors as prescribed, within 03 working days (previously 02 days) from the date of receipt of the dossier, the agency competent to appraise shall make a written request to the Standing The People's Council shall supplement and complete the dossier within 07 working days.
- Within 05 working days from the date of receipt of the document from the competent authority to appraise (enclosed with the application file of the Standing People's Council), the Prime Minister considers and approves the results. elect the Chairman, Vice Chairman of the Provincial People's Committee; Chairmen of People's Committees of provinces and districts shall consider and approve the results of election of Presidents and Vice-Chairmen of the People's Committees of the immediate lower levels.

In case the Prime Minister does not approve the election results of the Chairman, Vice Chairman of the Provincial People's Committee; If the chairperson of the People's Committee of the province or district does not approve the election results of the President or Vice Chairman of the People's Committee at the lower level, he/she must reply in writing, clearly stating the reason, and request the People's Council to re-elect the title. not approved.
