Adjustment of Regulations on Military and Police Officer Ranking

Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army and the Law on the People's Public Security (amended) all have changes regarding the promotion to the rank of general.

After being approved by the National Assembly deputies at the 8th session of the XIII term, Law amending and supplementing a number of articles of the Law on Vietnamese People's Army Officers and Law on People's Public Security (amended) shall take effect on July 1, 2015.

The Law amending and supplementing a number of articles of the Law on Vietnamese People's Army Officers amends 5 articles of the current Law and supplements 1 article.

Compared to the current Law, the amended and supplemented Law adjusts the regulations on the highest military rank as general for certain officer positions, and specifies the number of vice positions with the rank of general.

Military ranks are stipulated to fit the actual conditions in peacetime, with longer office-holding periods compared to wartime, thus saving human resources and training budgets, and facilitating the arrangement and use of officers.

The Law on Vietnamese People's Army Officers amended in 2014 clearly stipulates that the minimum time to consider promotion to general rank for active officers is 4 years for the following cases: from colonel to major general, Rear Admiral; from major general, Rear Admiral to lieutenant general, Vice Admiral; from lieutenant general, Vice Admiral to full general, Admiral; from full general, Admiral to general.

Active officers considered for promotion from colonel to major general, Rear Admiral must not exceed 57 years of age, except in cases required by the President.

Procedures for promotion, demotion, and stripping of military ranks for officers: The Prime Minister submits to the President for promotion, demotion, and stripping of the ranks of general, Rear Admiral, Vice Admiral, and Admiral. For officers of the ranks of lieutenant and captain, and salary increase for officers: procedures for promotion, demotion, and stripping are stipulated by the Minister of Defense.

The Law regulates that the salary table for officers is calculated based on the position, title held, and military rank, suitable with the characteristics and tasks of the military being a special labor sector. Officers are entitled to housing allowances, social housing policies, and assured of official residences as per legal regulations.

Police Officers receive promotion beyond the standard ranks

The 2014 Law on People's Public Security, compared to the 2005 Law on People's Public Security, does not change in the number of chapters but adds 2 articles on the procedures for granting and promoting military ranks and specifies the transitional provisions.

The law strictly and specifically regulates the positions and titles of police officers with the highest general rank (including basic positions and equivalent positions and titles).

The law clearly stipulates the highest military rank in the People's Public Security, as defined in Article 24. The highest military rank in the People's Public Security is the Minister of Public Security, with the ceiling military rank being general. The highest military rank for deputy ministers is full general (not exceeding six full generals).

Directors of Hanoi and Ho Chi Minh City Police are lieutenant generals. Heads of 6 departments, including Cybersecurity; Traffic Police; Fire Prevention, Fighting, Rescue, and Salvage Police; Foreign Affairs; Legal and Administrative Reform, Judicial Reform; and Building the People's Security Protection Movements, have the ceiling military rank of lieutenant general.

Positions and vice positions with the ceiling rank of major general are clearly stipulated in quantity. The law also specifies positions with the ceiling rank from colonel downwards.

The new law stipulates that the People's Public Security includes the People's Security Force, the People's Police Force, and the Commune Police. The old law only stipulated 2 forces, the People's Security Force, and the People's Police Force.

Students of the People's Public Security Schools, upon graduation, are granted the following ranks: intermediate level is granted the rank of sergeant; college level is granted the rank of staff sergeant; university level is granted the rank of second lieutenant. Cases of excellent graduation are granted promotion one rank higher. Accordingly,

The old law only stipulated “Students graduating from universities of the People's Public Security Schools are granted the rank of second lieutenant; students graduating from intermediate schools of the People's Public Security Schools are granted the rank of sergeant”. The law did not stipulate promotion beyond the standard ranks in cases of excellent graduation.
