4 new points to know about disciplinary actions for Communist Party organizations

From August 28, 2018, the handling of disciplinary actions against violating Communist Party organizations will be carried out in accordance with Regulation 07-QD/TW. Thu Ky Luat respectfully introduces some new points in the work of handling disciplinary actions against Communist Party organizations as follows:

  1. Supplementing the principles of disciplinary action for the Communist Party

In addition to the 08 principles as previously stipulated, Regulation 07 adds a 9th principle in dealing with disciplinary actions against violating Party organizations. To be specific: If the disciplined Communist Party organization has merged, split, or ceased operations, the announcement of the disciplinary decision shall be made at the directly superior Party organization of that Party organization.

  1. Specific regulations on the statute of limitations for disciplinary action

Previously, Regulation 263/QD-TW did not address the limitation period for disciplining a violating Party organization until Regulation 07 was issued, which supplemented this regulation. The limitation period for disciplinary action against a violating Communist Party organization is as follows:

- 05 years for violations subject to reprimand;- 10 years for violations subject to warning.

For violations subject to dissolution or violations concerning internal politics, security, defense, foreign affairs infringing upon national interests, there is no statute of limitations for disciplinary action.

The statute of limitations for disciplinary action is calculated from the time the Communist Party organization commits the violation. In cases where the Communist Party organization commits a new violation within the disciplinary action period, the statute of limitations for the old violation is calculated from the time the new violation is committed.

  1. Supplementing mitigating circumstances when considering Party disciplinary actions

According to Regulation 07, acts showing a spirit of voluntary and serious self-criticism, assisting the competent Party organization in accurately checking, considering, and promptly handling violating organizations and individuals, are also considered mitigating circumstances when considering Party disciplinary actions against violating organizations.

  1. Adding more violations subject to warning and dissolution discipline

  • Directing or orienting the dissemination of incorrect information regarding the policies, resolutions, directives of the Communist Party, and the policies and laws of the State;
  • Failing to take measures to promptly prevent and deal with Party members within the organization showing discontent, opposing internally.

  • Having responsibilities but failing to issue action programs or plans to implement the Communist Party's resolutions or directives as stipulated;
  • Negligence in leadership, direction, or in discussions, leading to the issuance of documents contrary to the Party's resolutions, directives, regulations, or the policies and laws of the State or upper levels;
  • Making decisions contrary to the resolutions, decisions, conclusions of the upper-level Party organs during the implementation process.
|| **Dissolution** | **Violations concerning political viewpoints, policies, and directives of the Communist Party, causing particularly serious consequences, specifically:**
  • Having policies to connect and associate with hostile forces, reactionaries, and opportunistic political elements to promulgate opposing viewpoints; mobilizing, propagandizing, organizing, and gathering forces to overthrow the Communist Party and the State;
  • Denying the leadership role of the Communist Party over the armed forces, demanding the "depoliticization" of the military and police; distorting the Party's all-people national defense and people's security lines.
