33 New Points in the Disciplinary Regulations for Communist Party Members - Part 1

The Central Executive Committee of the Communist Party of Vietnam has issued Decision 102-QD/TW stipulating the disciplinary measures for Communist Party members who violate regulations. This regulation replaces Regulation 181-QD/TW.

After updating the Regulation 102/QD-TW, Thu Ky Luat would like to present to our readers, those interested in disciplinary regulations for Communist Party members, 33 new points in disciplinary regulations. They include:

1. Addition of 01 new disciplinary principle:

For Communist Party members under consideration or undergoing disciplinary action, they shall not be transferred, appointed, promoted, or awarded military ranks; and shall not be granted titles by the Communist Party and the State.

2. New regulation on the statute of limitations for disciplinary action:

- 5 years for violations subject to reprimand.

- 10 years for violations subject to warning or dismissal.

- No statute of limitations for the following violations:

+ Violations that warrant expulsion;

+ Violations concerning internal politics;

+ Security, defense, and foreign affairs violations that harm national interests;

+ Use of illegal certificates, diplomas, and certifications.

3. Communist Party members who breach discipline due to objective reasons or coercion must proactively report to the organization for consideration for leniency.

4. Lack of honesty in declaring personal background, history, and supplementing Party member information will result in a reprimand.

5. Regarding violations of political views. additions include some offenses that will result in expulsion from the Communist Party:

- Rejecting or denying the principles of Democratic centralism, socialist democracy, and demanding the implementation of a "separation of powers," "civil society," or "multi-party system."

- Colluding with hostile, reactionary forces and politically dissatisfied elements to propagate opposing ideologies and viewpoints; mobilizing, organizing, and gathering forces to oppose the Party and State.

- Influencing, enticing, and directing public opinion against the Party's guidelines.

- Denying the Party's role in armed forces; demanding the "de-politicization" of the military and police; distorting the Party's comprehensive defense and people’s security policies.

- Denying the Party's leadership in media, literature, and the arts.

- Creating and promoting cultural and artistic products that distort history and diminish the reputation of the Party and the State leaders.

6. Failing to comply with the reporting policies, information policies, and addressing inquiries according to Party and State regulations will result in a reprimand.

7. Regarding violations of Democratic centralism principles, additional offenses that will result in a warning or dismissal include:

- Issuing documents or actions contrary to the resolutions, decisions, regulations, rules, or conclusions of the Party committee or organization.

- Abusing Democratic centralism to influence individuals, manipulate the collective, and make subjective decisions for personal gain, family, group, or kinship.

- Exploiting position and power to suppress subordinates and victimize individuals with minority opinions or contrary views.

- Disobeying leadership decisions, directives, resolutions, instructions, regulations, rules, or conclusions of the Party organization and superiors.

- Intentionally speaking and acting against the resolutions and decisions uniformly approved by the collective.

8. Expulsion from the Communist Party for Communist Party members who retaliate against those who give opinions, struggle, criticize, denounce, or provide information, documents, and evidence related to violations by their agency, unit, organization, or individual.

9. Communist Party members who fail to execute their electoral rights and duties as stipulated by law, causing disturbance at polling places, will be reprimanded regardless of intent.

10. Communist Party members who misuse their position, power, or the influence of individuals in authority to pressure those in authority to nominate relatives to leadership positions in the Party, State, Fatherland Front, and socio-political organizations will be warned or dismissed (previously only reprimanded for this offense).

11. Expulsion from the Communist Party for members who organize forces, groups, or kin to self-nominate and nominate individuals for State, Fatherland Front, and socio-political organizations' positions against regulations.
