1. Criteria for consideration and salary increase ahead of schedule in Vietnam

According to Article 2 of the Regulation on early salary increase for outstanding performance in carrying out tasks for civil servants, public employees, and labor contracts under Decree 68/2000/ND-CP issued together with Decision 2796/QD-BTC of the Ministry of Finance regulating civil servants, public employees, and labor contracts under Decree 68/2000/ND-CP dated November 17, 2000, during the period of holding the current salary grade, individuals must meet the following criteria to be considered for early salary increase based on outstanding performance, with a maximum of 12 months earlier than the prescribed time for regular salary increase when meeting the following standards:

 * For officials and civil servants:

  • Standard 1: Evaluated by competent authorities from the level of task completion but limited capacity upwards;
  • Standard 2: Do not violate discipline in the form of reprimand, warning, demotion, or dismissal.

* For officials:

  • Standard 1: Evaluated by competent authorities from the level of task completion upwards;
  • Standard 2: Do not violate discipline in any of the forms of reprimand, warning, or dismissal.

At the same time, you must establish excellent achievements in performing tasks that have been recognized in writing by a competent authority, and in considering salary increases ahead of schedule, you must achieve the title of advanced worker or higher.

Furthermore, Article 2 of the Regulation issued together with Decision 2796/QD-BTC also stipulates that by December 31 of the year of early salary increase consideration, if individuals have not reached the final salary grade in the position or title and there is a shortage of less than 12 months to be eligible for regular salary increase, they can be considered for early salary increase for a maximum of 12 months earlier than the prescribed time for regular salary increase in the current position or title.

2. Cases not subject to consideration for an early salary increase in Vietnam

According to Article 3 of the Regulations issued together with Decision 2796/QD-BTC, cases that are not subject to consideration for an early salary increase due to excellent achievements include:

(1) During the period of holding the current salary grade, individuals have received written notifications or decisions from the authoritative authority stating that they have not fulfilled the assigned tasks annually or have been disciplined according to the disciplinary measures stipulated in the Law on Officials and Public Employees, the Law on Public Employees, and the current regulations of the competent authority.

(2) Enough time has passed to increase the regular salary level according to regulations during the year to consider raising the regular salary level (as of December 31 of the year considered).

(3) Failure to make two consecutive salary increases ahead of time due to excellent achievements in performing tasks in the same rank or title.

3. Time to calculate and enjoy the salary increase ahead of schedule in Vietnam

Article 10 of the Regulation issued together with Decision 2796/QD-BTC stipulates the basis for considering the period for early salary increase (12 months, 9 months, 6 months), and the effective date of the new salary grade resulting from the early salary increase is calculated from the date when civil servants or public employees have held the current salary grade plus the number of months of early salary increase according to the regulations for regular salary increase.

It can be simply understood that the time for a new salary increase is determined by subtracting the number of months of salary increase before the deadline from the expected time of regular salary increase.

For example: Ms. Le Thanh Tu is a civil servant at the Tax Department of District 3 - City. Ho Chi Minh. From 2014 to present, Ms. Tu's work progress, salary, and achievements are as follows:

- In February 2014, there was a decision to recognize the title of grassroots emulation soldier.

- In October 2014, he was disciplined in the form of a reprimand and had his regular salary review period extended for 6 months.

- Ms. Tu received a regular salary increase: from level 5/9 specialist rank with a coefficient of 3.66 to level 6/9 specialist rank with a coefficient of 3.99 as of January 1, 2017. (Mrs. Tu's previous salary level was from July 1, 2013).

- 2017: In January 2017, she was recognized as an advanced worker in 2016 and, at the end of the year, was evaluated for successfully completing its tasks.

- 2018: In April 2018, Ms. Tu was recognized as a Grassroots Emulation Soldier in 2018 and, at the end of the year, was evaluated for completing her mission well.

- 2019: In January 2019, it was recognized as an advanced worker, and at the end of the year, it was evaluated for completing its tasks well.

On January 25, 2020, the Council considering raising the salary level ahead of schedule of the Department of Taxation of District 3, agreed to grant an early salary increase of 9 months to Ms. Tu, from grade 6/9 specialist, coefficient 3.99, to grade 7/9 specialist, coefficient 4.32, and the effective date for the new salary grade will be April 1, 2019.
