(3) Applies to the cases specified in Clause 2, Clause 3, Clause 4, Clause 5, Clause 6 Article 20; Clause 1, Article 25 of the Law on Residence, specifically:
1. Citizens may register for permanent residence in a legal residence that is not owned by them when the householder and the owner of that legal residence agree in the following cases:
- The wife returns to live with her husband; the husband returns to live with his wife; the children return to live with their parents; and the father and mother return to live with their children;
- Elderly people come to live with their siblings, nieces, and nephews; People with extremely severe disabilities, people with severe disabilities, people unable to work, people with mental illness or other diseases that cause loss of cognitive ability and ability to control behavior go to live with grandparents, siblings, biological aunt, paternal uncle, paternal aunt, paternal niece, and guardian;
- Minors with the consent of their parents or guardians, or who no longer have parents, return to live with their grandparents, siblings, aunts, uncles, aunts, nieces, or guardians;
2. Except for case 1 above, citizens can register for permanent residence in legal accommodation rented, borrowed, or temporarily stayed when meeting the following conditions:
- Obtain the consent of the owner of the legal residence to register permanent residence at the rented, borrowed, or stayed place and obtain the consent of the householder if registering permanent residence in the same household;
- Ensuring the minimum housing area conditions prescribed by the Provincial People's Council but not lower than 08 m2 of floor space/person.
3. Citizens may register for permanent residence at a belief facility or a religious facility with ancillary housing facilities when falling into one of the following cases:
- Religious activists are ordained, appointed, elected, nominated, or transferred to religious activities at religious establishments;
- Representative of a religious establishment;
- A person whose representative or management board of a religious facility agrees to register for permanent residence to directly manage and organize religious activities at the religious facility;
- Children, people with particularly severe disabilities, people with severe disabilities, and helpless people with representatives or management boards of religious establishments, the head or representative of the religious establishment agrees to permanent residence registration.
4. The person being cared for, nurtured, or assisted may register for permanent residence at a social assistance facility with the consent of the head of that facility or be registered for permanent residence in the household receiving care or nurture. when agreed by the householder and legal residence owner.
5. People living or working on a vehicle may be registered to permanently reside in that vehicle when they meet the following conditions:
- Being the owner of the vehicle or have the vehicle owner's consent to register permanent residence;
- The vehicle is registered and inspected according to the provisions of law; in case the vehicle is not subject to registration or inspection, there must be confirmation from the People's Committee of the commune that the vehicle is regularly parked for residential purposes;
- There is confirmation from the People's Committee of the commune that the vehicle is registered and parked regularly in the area in case the vehicle does not have to be registered or the place where the vehicle is registered does not coincide with the place where it is regularly parked.
6. Household members can separate households to register permanent residence at the same legal residence when meeting the following conditions:
- Having full legal capacity; In case many members register to separate households to form a new household, among those members, at least one person has full civil act capacity;
- Having obtained consent from the head of the household or the owner of the legal residence, except in cases where the household members registering to separate the household are divorced spouses but still can use the same legal residence;
- The household's permanent residence does not fall into the cases specified in Article 23 of the Law on Residence.
(4) Applicable to cases where minors, persons with restricted civil acts, and persons without civil act capacity have changed their residence information.
2. What are the cases of the declaration of change of residence information in Vietnam?
According to Clause 1, Article 3, Circular 56/2021/TT-BCA, the declaration of change of residence information (symbolized as CT01) is used when citizens carry out procedures for permanent residence registration, deletion of permanent residence registration, separation of households, and adjustment of information in the Residence Database, register temporary residence, delete temporary residence registration, extend temporary residence, declare residence information, and confirm residence information.
3. To adjust residence information in the Residence Database in Vietnam
According to Article 10 of Circular 55/2021/TT-BCA, adjusting residence information in the Residence Database is done as follows:
- In case there is a change in the head of household, the opinion of the head of household must be included in the declaration of change in residence information (except in cases where there has been written consent), the unanimous nomination of household members, or the Court's document deciding on the head of the household.
In the event that the head of household dies, is missing, or loses civil act capacity, in addition to the unanimous nomination of household members, there must be a Death Certificate or a Court Decision declaring death, disappearance, or loss of civil act capacity.
- In case there is a change in civil status compared to information in the residence database, there must be papers and documents proving permission for the change from the competent authority on civil status registration.
In case there is information about changes in the Electronic Civil Status Database, citizens do not have to present documents or proof.
- In case there is a change in residential address due to an adjustment in administrative boundaries, name of administrative unit, name of street, residential group, village, hamlet, or house numbering method, the competent residence management agency, based on the document changing the administrative boundary, name of administrative unit, name of street, residential group, hamlet, house numbering method, has the authority to make adjustments and updates to information about residence addresses in the Residence Database.
