2. Marriage registration documents with foreign elements in Vietnam

A marriage registration dossier with foreign elements includes:

- A marriage registration declaration completed in accordance with Section 1's form, with sufficient information about both the male and female parties If the requester chooses to submit the application directly, both men and women can jointly declare in a marriage registration declaration.

- An interactive electronic marriage registration form (completed by the requester following the instructions on the Public Service Portal if the requester chooses to submit the application in the online form);

- Persons who request marriage registration shall submit/present (in person) or upload (online form) the following documents:

* Documents to be submitted:

- A certificate from a competent Vietnamese or foreign medical organization certifying that the married parties do not suffer from mental illness or other diseases without the ability to perceive and control their acts;

- Papers proving the marital status of the foreigner issued by the competent authority of the country of which he is a citizen are still valid, certifying that he is currently unmarried or without a husband; In case the foreign country does not issue a certificate of marital status, it shall be replaced with a document issued by a foreign competent authority certifying that the person is eligible for marriage under the laws of that country.

The value of papers proving the marital status of foreigners shall be determined according to the stated duration on such papers. If the papers proving marital status do not have an expiration date, this paper and the medical organization's certification are valid for 6 months from the date of issue.

- Foreigners and Vietnamese citizens residing abroad must submit a copy of their passport/passport replacement document.

- Certificate of marital status of Vietnamese citizens residing in the country. In the event that marital status information is already available in the e-mail database, the NVDC, it is not required to present it (in direct form) or upload it (in the online form).

* In addition to the above documents, depending on the case, the male and female parties must submit the following corresponding documents:

- Vietnamese citizens who have divorced or canceled their marriage through a competent foreign agency must submit a copy of the civil status extract from the book indicating the divorce or illegal marriage cancellation. (Excerpt from divorce notes);

- Vietnamese citizens who are civil servants, public employees, or members of the armed forces must submit a document from the management agency or unit certifying that their marriage to a foreigner does not violate the branch's regulations.

- Marriage registration applicants who are working, studying, or working abroad for a definite term must submit a certificate of marital status issued by diplomatic missions, consular missions of Vietnam abroad.

* Documents to be presented:

- Passport or people's identity card, citizen identification card, or other papers with photos and personal information issued by competent authorities, still valid for use to prove the identity of Vietnamese citizens. If the personal information in these documents is already in the National Database, an electronic database, and is automatically filled in by the system, it is not necessary to present (in direct form) or upload (in online form).

- Foreigners present the original passport to prove their identity; In the event that they do not have a passport to present, they can present an international travel document or a residence card.

- Proof of residence is required to determine the marriage registration authority. In case the information about the documents proving the place of residence is already in the National Park Service, is automatically filled in, it is not required to be presented in person or uploaded (in the online form).
