From July 1, 2023, to increase the base salary from 1.49 million VND to 1.8 million VND.

According to Article 38 of the Law on Social Insurance 2014, female employees giving birth are entitled to a lump-sum allowance equaling 2 times the statutory pay rate for each child in the month of childbirth or child adoption.

In case the mother gives birth to a child but only the father is covered by social insurance, the father is entitled to a lump-sum allowance.

If you give birth starting July 1, 2023, the lump-sum allowance at birth will be 3.6 million VND (an increase of more than 600,000 VND compared to the present).

If the child is born before July 1, 2023, the lump-sum allowance when giving birth will be calculated according to the base salary of 1.49 million VND (i.e., only 2.98 million VND).

Also, from July 1, 2023, the employee's postnatal convalescence allowance level also has a large adjustment.

Article 41 of the Law on Social Insurance 2014 stipulates that:

Female employees whose health has not yet recovered within the first 30 working days after the maternity leave period, are entitled to a leave for convalescence and health rehabilitation of between 5 and 10 days.

The number of days of a leave period for convalescence and health rehabilitation shall be jointly decided by the employer and grassroots Trade Union Executive Committee, or by the employer in case the grassroots Trade Union organization has not yet been set up.

The maximum leave period for convalescence and health rehabilitation is:

- 10 days, for female employees who give birth to twins or more infants;

- 7 days, for female employees who have a surgical birth;

- 5 days, in other cases.

The per-diem allowance for convalescence and health rehabilitation after maternity leave period must equal 30% of the statutory pay rate.

Calculated according to the base salary of 1.49 million VND (applied until the end of June 30, 2023).

Calculated according to the base salary of 1.8 million VND (applied from July 1, 2023).

Thus, depending on the time of convalescence and rehabilitation, the level of benefits received will be different.

For example: in the case of vaginal delivery, female employees are entitled to 5 days of convalescence after giving birth (from July 1, 2023).

During these 5 days, female workers will receive a daily allowance of 540,000 VND. A total of 2.7 million VND

Latest update on the application to request maternity leave after giving birth in Vietnam

Dossiers for enjoying postnatal convalescence are specified at Point 2.4, Clause 2, Article 4, and Process promulgated together with Decision 166/QD-BHXH dated January 31, 2019.

Accordingly, female employees who enjoy the postnatal convalescence and health rehabilitation regime must make one set of dossiers as prescribed in Clause 5 and Article 101 of the Law on Social Insurance 2014.

Dossier for postnatal convalescence and health rehabilitation regime enjoyment includes:

A certificate from a competent medical examination and treatment facility that the mother is no longer healthy enough to take care of the child after giving birth;

Extract a copy of the mother's medical record or hospital discharge certificate in case the child dies after birth without a birth certificate;

A certificate from a qualified medical examination and treatment facility stating that the female employee needs to take time off to care for her pregnancy; health recovery

A copy of the child's birth certificate or a copy of the child's birth certificate;

A copy of the child's death certificate in case the child dies, and a copy of the mother's death certificate in case the mother dies after giving birth.
