This is a notable regulation in Decree 28/2020/ND-CP stipulating administrative penalties in the fields of labor, social insurance, and sending Vietnamese workers to work abroad under contracts.

This Decree has shortened the stipulated period for employers to pay labor accident insurance and occupational disease insurance policies to employees.
To be specific, Clause 1 Article 40 Decree 28/2020/ND-CP states:
1. A fine ranging from VND 1,000,000 to VND 2,000,000 for violations involving one employee but not exceeding VND 75,000,000 for the employer who fails to pay the labor accident and occupational disease insurance policies within 10 days from the date of receiving the money transferred by the social insurance agency.
Therefore, from April 15, 2020, employers are responsible for paying the labor accident and occupational disease insurance policies within 10 days from the date of receiving the money transferred by the social insurance agency. If this period is exceeded, the employer may be fined up to VND 2,000,000 for each employee violation.
Currently, according to the provisions of Clause 21 Article 1 Decree 88/2015/ND-CP amending point b Clause 2 Article 28 of Decree 95/2013/ND-CP, the payment period is no more than 15 days from the date of receiving the payment decision from the social insurance agency.
It can be seen that, aside from shortening the payment period of labor accident and occupational disease insurance policies, Decree 28 also redefines the starting point for employers to pay these policies. This change is entirely practical, as the new regulation enables employees to receive their payment sooner, and the social insurance agency is responsible for transferring the money promptly to ensure the benefits of the employees.
