Labor and Insurance Policies Effective from April 2017

From April 2017, many new policies in the fields of Labor - Salary, Insurance take effect. Notably among them are:

  1. Addition of Level IV Training Sectors for Intermediate and College Levels in 2017

This is the content mentioned in Circular 04/2017/TT-BLDTBXH regarding the list of Level IV training sectors at the intermediate and college levels.

The regulation specifies 67 group sectors belonging to 23 training fields at the intermediate and college levels. Some changes to the sectors receiving Level IV training (including sectors with 07-digit code) are as follows:

- Mechanical Engineering and Technical Mechanics Group: adding the sector "Aircraft Mechanical Maintenance Engineering" at the College level;- Chemical Engineering, Materials, Metallurgy and Environmental Group: adding the sector of Water Drainage and Wastewater Treatment Engineering at the Intermediate and College levels.

  1. Organizing the Action Month on Occupational Safety and Hygiene in May

This is a significant content mentioned in Circular 02/2017/TT-BLDTBXH, guiding the organization of the Action Month on Occupational Safety and Hygiene, effective from April 6, 2017. Accordingly:

- The Action Month on OSH is organized from May 1 to May 31 each year.- The launching ceremony of the Action Month on OSH is held on a day within the period from May 1 to May 10 each year.

Circular 02/2017/TT-BLDTBXH is effective from April 6, 2017, replacing the organization of the National Week on Occupational Safety and Hygiene – Fire and Explosion Prevention according to Guidance 4280/BCDTLQG-ATLD dated November 30, 2006.

  1. New Regulations on Salary, Allowances for Defense Workers and Public Employees

On February 24, 2017, the Government of Vietnam issued Decree 19/2017/ND-CP on salary policies for defense workers and seniority allowances for defense public employees.

Salary policies for defense workers are regulated as follows:

- The salary level is calculated by multiplying the salary coefficient by the statutory pay rate as prescribed by the Government of Vietnam.- The salary coefficient is detailed in the salary table issued with the Decree; classified into three categories A, B, C with four groups of subjects, 10 salary grades, with the highest coefficient up to 6.65 and the lowest being 2.70.

Additionally, various types of allowances and subsidies for defense workers are regulated as follows:

- Overframe seniority allowance;- Regional allowance;- Special allowance;- Hazardous and dangerous allowance;- Work responsibility allowance;- Civil service allowance;- Allowance and subsidy for working in areas with especially difficult socio-economic conditions.

Decree 19/2017/ND-CP is effective from April 15, 2017, with policies applied from July 1, 2016.

  1. Conditions for Officials to Apply for Intermediate and College Education

From April 15, 2017, the recruitment and enrollment target determination for intermediate and college levels will be implemented according to regulations in Circular 05/2017/TT-BLDTBXH.

Officials and public employees working at agencies, units, state enterprises, political organizations, and socio-political organizations are eligible to apply for intermediate and college education if they meet the following conditions:

- Graduated from junior high school or equivalent and above (for intermediate level) or graduated from high school or equivalent and above (for college level);- Approved by the head of the competent authority to allow study (if using state budget for study).

The application dossier includes:

- Enrollment registration form;- Valid copies of necessary documents (depending on the requirements and selection criteria of each school).

Candidates can submit the dossier and enrollment fee directly, online or by post.

  1. Evading or Late Payment of Social Insurance of Employees Will Be Recovered and Paid Compulsorily

According to Circular 37/2017/TT-BQP guiding the management of compulsory social insurance collection and expenditure in the Ministry of Defense (effective from April 2, 2017), it shall carry out the recovery and compulsory payment of the monthly salaries for compulsory social insurance within the Ministry of Defense for employees and employers in the following cases:

- Adjusting the increase of the monthly salary already paid for social insurance for employees;- Compensating for the unpaid period of employees working abroad under labor contracts;- Evading, delaying, and appropriating the social insurance contributions of employees.
