Persons with disabilities who are beneficiaries of social protection are provided with health insurance cards by the State and are entitled to the highest benefits, which is 100% coverage of medical examination and treatment costs under health insurance as stipulated.
According to Decree 136/2013/ND-CP dated October 21, 2013, by the Government of Vietnam prescribing the social assistance policies for social protection beneficiaries, social protection beneficiaries provided with health insurance cards by the State include: Children under 16 years old without a source of support in one of the cases as prescribed in the Decree (abandoned without anyone adopting, orphaned, parents missing, either parent is enjoying policies of care and fostering at social protection institutions...); children of single poor persons (persons belonging to poor households without a husband or wife, whose husband or wife has died, whose husband or wife is missing according to legal regulations, and are raising children under 16 years old or raising children from 16 to 22 years old but those children are attending secondary schools, vocational schools, professional secondary schools, colleges, or first-degree universities); persons with severe disabilities and persons with extremely severe disabilities; persons aged 80 years or above who are enjoying monthly death benefit allowances from social insurance, other monthly allowances but have not been issued free health insurance cards.
Regarding the health insurance benefits, based on the Law on Amendments and Supplements to a Number of Articles of the Law on Health Insurance, Article 22 stipulates that persons with disabilities participating in health insurance upon medical examination and treatment as prescribed shall have their costs for medical examination and treatment covered by the Health Insurance Fund within the covered scope with a benefit rate of "100% of the medical examination and treatment costs for persons specified at points a, d, e, g, h, and i clause 3 Article 12 of this Law. The costs for medical examination and treatment outside the covered scope of health insurance for persons specified at point a clause 3 Article 12 of this Law shall be paid from the health insurance fund for medical examination and treatment of this group of beneficiaries; in case this fund is insufficient, the state budget shall ensure it;…”.
To determine the level of disability, Article 15 of the 2010 Law on Persons with Disabilities stipulates that the determination of the disability level shall be performed by the Disability Level Determination Council. In the following cases, the disability level shall be determined by the Medical Assessment Council: the Disability Level Determination Council fails to give a conclusion on the disability level; the person with disabilities or their legal representative disagrees with the conclusion of the Disability Level Determination Council; there is concrete evidence that the Disability Level Determination Council's determination of the disability level is not objective and accurate. Regarding the procedure for determining the disability level, when there is a need to determine the disability level, the person with disabilities or their legal representative shall submit an application to the People's Committee of the commune where the person with disabilities resides. Within 30 days from the date of receipt of the application for disability level determination, the Chairman of the commune People's Committee shall convene the Disability Level Determination Council, send a notice of the time for determining the disability level to the person with disabilities or their legal representative. The Disability Level Determination Council shall organize the determination of the disability level, prepare a dossier on the disability level determination, and conclude. Within 05 working days from the date the Disability Level Determination Council makes a conclusion, the Chairman of the commune People's Committee shall post and publicly announce the conclusion of the Disability Level Determination Council and issue the disability certification.
