Hanoi-Vietnam: Reduction of statutory minimum wage as the basis for social insurance premium payment under new regulations

This is the notable content based on the provisions of the Draft Decree on amendments to some articles of Decree 49/2013/ND-CP detailing the implementation of a number of articles of the Labor Code on wages in Vietnam (Draft Decree amending wages).

FULL TEXT OF THE DRAFT DECREE AMENDING THE REGULATIONS ON WAGES IN VIETNAM

Under the current regulations, the statutory minimum wage as the basis for social insurance premium payment for trained employees and those who have attended vocational training must be at least 7% higher than the regional-based minimum wage in Vietnam.

However, in the Draft Decree amending the regulations on wages, the statutory minimum wage for trained employees and those who have attended vocational training will be reduced from at least 7% higher to at least 5% higher than the regional-based minimum wage.

2. Amend and supplement point b, clause 3, Article 7, Chapter III Decree 49/2013/ND-CP as follows:

Option 2: “b) The statutory minimum wage for jobs or positions requiring vocational training at primary levels or equivalent must be at least 5% higher than the regional-based minimum wage as stipulated by the Government of Vietnam.”

Thus, if the Draft is approved, the statutory minimum wage as the basis for social insurance premium payment will decrease correspondingly to the reduced regional-based minimum wage applicable to trained employees and those who have attended vocational training.
