Conditions for Participation in Social Insurance via Electronic Transactions - Draft

Social Insurance Procedures

Social insurance procedures are among those that are closely linked to the daily lives of workers. Therefore, the Government of Vietnam has implemented the "digitization" of procedures for participation in Social Insurance (BHXH), Health Insurance (BHYT), and Unemployment Insurance (BHTN) to reduce the time and costs for both workers and social insurance agencies. It is hoped that there will no longer be scenes of "crowding for hours" to submit or withdraw Social Insurance records.

Decision No. 08/2015/QD-TTg was issued by the government on May 1, 2015, marking the first pilot implementation of electronic transactions in the procedures for participating in social insurance, health insurance, unemployment insurance, and the request for issuance of social insurance books and health insurance cards by the Prime Minister of the Government of Vietnam. One year after the decision was piloted, statistics showed that enterprises were quite enthusiastic about the new process, with nearly 70% of enterprises participating in social insurance using electronic transactions. The number of hours to complete procedures decreased by up to 75% compared to the same period last year, which is quite an impressive figure.

According to the content of Decision No. 08, implementing social insurance through electronic transactions involves the Social Insurance Agency granting the service right to receive, transmit, store, and recover electronic transaction data messages in the field of social insurance between employers and the Social Insurance Agency to a third-party specialized organization. This organization is the Value-Added Network Service Provider in social insurance transactions (I-VAN).

However, the pilot implementation of electronic transactions under Decision No. 08/2015/QD-TTg has only stopped at the execution of procedures for participating in social insurance, health insurance, unemployment insurance, and the request for issuance of social insurance books and health insurance cards; it has not yet been implemented for procedures concerning the resolution and payment of social insurance benefits, health insurance, or unemployment insurance.

Recently, the Ministry of Labor - Invalids and Social Affairs has drafted a Draft Decree regulating electronic transactions in social insurance, health insurance, and unemployment insurance consisting of 6 chapters and 31 articles. In general, besides inheriting regulations, the draft has added some important points about the conditions for participating in social insurance through electronic transactions and added legal value to insurance documents. However, the draft still does not address the content of resolving and paying out benefits on social insurance policies like SI, HI, and UI, as many participating individuals and organizations wish.

The content and conditions for implementing electronic transactions in social insurance are specified in Clause 1, Article 5 of the Draft, as follows:

- Agencies, organizations, and individuals conducting electronic transactions in social insurance must meet the following conditions:

- Possess a digital signature certificate as regulated in Clause 3, Article 4 of this Decree;- Have the ability to access and use the Internet; have a stable contact email address registered with Vietnam Social Security.

Agencies, organizations, and individuals conducting electronic transactions in social insurance can choose to conduct electronic transactions directly through the Vietnam Social Security Portal or through the I-VAN Organization as regulated.

The draft is still under consultation by the Ministry of Labor - Invalids, and Social Affairs.
