Conditions and Benefit Rates for Unemployment Benefits for Employees in Vietnam

When participating in Social Insurance, employees in Vietnam who meet the necessary conditions will be entitled to unemployment benefits. What are the conditions and entitlement levels of unemployment benefits in Vietnam?

According to the provisions of Article 3 of the 2013 Employment Law, unemployment insurance is a policy aimed at partially compensating the income of employees when they lose their jobs, supporting them in vocational training, maintaining employment, and finding jobs based on contributions to the Unemployment Insurance Fund. The unemployment insurance benefits that employees in Vietnam can receive include:

- Unemployment benefits;

- Support for consultation and job introduction;

- Vocational training support;

- Support for training, fostering, and improving professional skills to maintain employment for employees.

Among the policies of Unemployment Insurance, unemployment benefits are the main content that employees aim to receive. To be eligible for unemployment benefits, employees in Vietnam must meet the following legal conditions:

1. Termination of labor contract or working contract, except for the following cases:

- The employee unilaterally terminates the labor contract or working contract illegally;

- Receiving pension, monthly loss of work capacity benefits;

2. Duration of Unemployment Insurance Participation:

- Having paid unemployment insurance for at least 12 months within 24 months before terminating the labor contract or working contract for the cases stipulated in points a and b, Clause 1, Article 43 of the 2013 Employment Law;

- Having paid unemployment insurance for at least 12 months within 36 months before terminating the labor contract for the cases stipulated in point c, Clause 1, Article 43 of the 2013 Employment Law;

3. Submitted the application for unemployment benefits at a job service center as stipulated in Clause 1, Article 46 of the 2013 Employment Law.

4. Not having found a job within 15 days from the date of submitting the application for unemployment insurance, except for the following cases:

- Performing military service, police service;

- Going for study for a term of 12 months or more;

- Following the decision to apply measures to be put into reformatory, compulsory education facility, or compulsory detoxification facility;

- Being in temporary detention; serving imprisonment;

- Going abroad for permanent residence; going to work abroad under a contract;

- Dead.

The level of unemployment benefits is calculated according to the formula:

Level of Benefits = 60% x Average monthly salary of the last 6 months before unemployment

In addition to unemployment benefits, employees in Vietnam are also entitled to other Unemployment Insurance policies such as free consultation and job introduction; support for vocational training when they meet the conditions stipulated. employees need to pay attention to these policies to ensure they receive all the benefits according to the law.
