On September 28, 2017, the Ministry of Labor, Invalids and Social Affairs issued Official Dispatch 4110/LDTBXH-BHXH regarding the implementation of social insurance (SI) for commune-level police.
According to the provisions of the 2014 Social Insurance Law, commune-level officials and non-specialized individuals working at the commune level are subject to mandatory social insurance participation.
According to the provisions of Decree 92/2009/ND-CP and Decree 29/2013/ND-CP, the Chief of Police is a commune-level official. The provincial People's Committee is responsible for providing specific regulations on the quantity and titles of non-specialized individuals working at the commune level to the provincial People's Council.
Thus:
- The Chief of Commune Police is subject to mandatory social insurance participation.- The Deputy Chief of Commune Police and commune police officers, as decided by the provincial People's Council, fall under the titles of non-specialized individuals working at the commune level and are also subject to mandatory social insurance participation.
If not falling under the titles of non-specialized individuals working at the commune level, they can participate in voluntary social insurance.
The implementation of social insurance policies for the Chief of Commune Police, Deputy Chief of Commune Police, and commune police officers is specifically governed by the Social Insurance Law and guiding documents. Regarding health insurance, the provisions of the Health Insurance Law and guiding documents apply.
