1. What is the National Insurance Database?

According to Clause 1, Article 3 of Decree 43/2021/ND-CP, the National Insurance Database is a national database that stores information about social insurance, health insurance and unemployment insurance and about health and social security recognized by competent authorities and to ensure the insurance rights and obligations of citizens.

Specifically, the National Insurance Database is a Government database that is uniformly built across the country and used by all agencies, organizations and individuals in order to provide accurate and timely information on insurance serving the state management, meeting socio-economic development requirements and legitimate requirements of agencies, organizations and individuals.

2. Users of data from the National Insurance Database in Vietnam

Users of data from the National Insurance Database are specified in Article 10 of Decree 43/2021/ND-CP, specifically as follows:

(1) Vietnam Social Security shall use the data from National Insurance Database for insurance professional practices.

(2) The Ministry of Labor, War Invalids and Social Affairs shall use the data for state management of social insurance, employment and social security.

(3) The Ministry of Health shall use the data for state management of health sector, including health insurance data.

(4) The Government's Office shall use the data for direction and administration of the Government and the Prime Minister.

(5) Ministry of Information Technology and Communications shall use the data in combination with other sources of data to create increased information for the purpose of advising and supporting the promulgation of policies in e-Government and digital Government.

(6) The Ministry of Public Security and the Ministry of National Defense shall use the data for state management of national defense and security.

(7) Regulatory agencies shall, within their ambit of functions and tasks, use the data for state management.

(8) Agencies, organizations and individuals are permitted use their own information; or personal information of another person if the consent is given in accordance with the law.

3. Methods of using data from the National Insurance Database in Vietnam

Specifically, in Article 11 of Decree 43/2021/ND-CP, the methods of exploiting and using data from the National Insurance Database are prescribed as follows:

- Agencies, organizations and individuals shall use data from National Insurance Database via National Data Portal, National Public Service Portal, VSS Portal and other forms provided by the competent authority.

- Agencies, organizations and individuals have the right to extract their information from the National Insurance Database.

The extracted data is digitally signed by the Vietnam Social Security and is valid as certified by a competent authority.

- Agencies and organizations are not allowed to request an individual to provide relevant documents if they have obtained the personal information from the National Insurance Database.

4. Prohibited acts with respect to the National Insurance Database in Vietnam

Individuals and organizations are not allowed to perform the following acts with respect to the National Insurance Database:

- Providing false information.

- Sabotaging the information infrastructure system or obstructing the operation and maintenance that keeps the National Insurance Database stable and uninterrupted.

- Gaining unauthorized access to the National Database of Insurance; copying, misleading information, changing, deleting or destroying data illegally in the National Database on Insurance.

- Exploiting, using or revealing information from the National Database of Insurance against the regulations, infringing on the rights to private life, personal secrets and family secrets.
