05 changes in policies of enjoying social insurance and health insurance for employees, officials and public employees from 2021 in Vietnam

It won't be long before officially entering the new year 2021, this is the time when many important policies take effect, one of which is the policy of enjoying social insurance and health insurance for employees, officials and public employees in Vietnam.

LAWNET would like to send to Customers and Members 05 main changes in policies of enjoying social insurance and health insurance for employees, officials and public employees from 2021:

1. Increase the retirement age of employees under normal working conditions

According to Clause 2 Article 169 of the Labor Code 2019 of Vietnam and Article 4 of the Decree No. 135/2020/NĐ-CP of Vietnam’s Government, From 2021, the retirement ages of employees in normal working conditions shall be 60 years 03 months for males and 55 years 04 months for females; and shall increase by 03 months for males and 04 months for females after every year.

2. Male employees who have paid full 19 years of social insurance premiums are entitled to a pension enjoyment rate of 45%

According to Clause 2 Article 56 of the Law on social insurance 2014 of Vietnam, the monthly pension of employees who fully satisfy the conditions for pension will equal 45% of the average monthly salary on which social insurance premiums are based and correspond to the following period of social insurance premium payment:

- 19 years for male employees who retire in 2021;

- 15 years for female employees who retire since 2018;

To enjoy the pension at the maximum rate of 75%, employees must have the minimum number of years of social insurance payment (retirement in 2021) as follows:

- Pay at least 34 years of social insurance for male employees;

- Pay at least 30 years of social insurance for female employees.

3. Roadmap of retirement ages under ordinary working conditions associated with corresponding months and years of birth

The Appendix I on the roadmap of retirement ages under ordinary working conditions associated with corresponding months and years of birth is enclosed together with the Decree No. 135/2020/NĐ-CP of Vietnam’s Government. View more details HERE.

4. Increase the level of health insurance benefits when going for medical examination and treatment at provincial hospitals

According to Article 22 of the Law on health insurance 2008 of Vietnam amended in 2014, from January 01, 2021, the level of health insurance benefits will be changed when going off-line for medical examination and treatment. Specifically, the health insurance benefits of the holders of the health insurance card when going for medical examination and treatment at a provincial hospital are covered by the health insurance fund 100% of the cost of inpatient treatment nationwide. (Currently, until the end of December 31, 2020 is 60% of inpatient treatment costs). 

For medical examination and treatment at central hospitals, the level of 40% of inpatient treatment costs remains unchanged; at district hospitals is 70% of medical examination and treatment costs.

5. From April 1, 2021, participants of health insurance will be issued with a card with a unique social insurance number

According to the Decision No. 1666/QĐ-BHXH, from April 01, 2021, the new Health Insurance Card Model will be officially applied nationwide. In particular, when the health insurance card template is applied, each insured person will be issued a card with a unique social insurance number. Thus, just using this social insurance number and registering transactions at https://dichvucong.baohiemxahoi.gov.vn, people can continue to participate in health insurance, re-issue and change health insurance cards, check the costs of medical examination and treatment covered by health insurance.

Moreover, people should note that, while waiting for the replacement of the health insurance card according to the provisions of Decision No. 1666/QĐ-BHXH (effective on April 01, 2021), if the health insurance card issued to the insured is still valid, used to continue to be used for medical examination and treatment covered by health insurance. Simultaneously, blanks of health insurance cards printed under Decision No. 1313/QD-BHXH that have not been used up until April 01, 2021, may continue to be used and issued to participants of health insurance.
