Recently, the Ministry of Natural Resources and Environment issued Official Dispatch 703/BTNMT-TCQLDD to the Departments of Natural Resources and Environment of provinces and centrally-governed cities providing guidance on land use policies and the certification of ownership rights for non-residential construction works.
In cases where the projects with tourist apartments, tourist villas (condotels) meet the conditions for transfer as stipulated by the Law on Real Estate Trading, the certification of ownership (red book) for the transferee shall be executed in accordance with the provisions of Article 32 of Decree 43/2014/ND-CP and Clause 22, Article 2 of Decree 01/2017/ND-CP.
The Ministry of Natural Resources and Environment (BTNMT) requests the Departments to organize a review of the approved investment projects and the allocation and leasing of land for each project to determine the land use purposes and the land use term in accordance with the land law.
If the conditions are met, the Certificate of Land Use Rights (GCN) shall be issued to the land users and the owners of the assets attached to the land, ensuring that the scale, objectives, and planning of the project are not altered.
