Pursuant to Clause 1 Article 24 of the Circular 04/2022/TT-BXD (takes effect from 01/01/2023) stipulating drawing included in dossiers on tasks in special purpose zone planning in Vietnam as follows:

1. The drawing includes diagram of location and relationship in provincial planning, regional planning; map of the boundaries and scope of planning. The drawing shall be shown in map of orientation to organization of space and map of zoning in regional planning, plan for organization of space and zoning in provincial planning and map of land use planning in provincial planning that has been approved at an appropriate scale.

What are included in the description of dossiers on tasks in special purpose zone planning in Vietnam?

Pursuant to Clause 2, 3 and 4, Article 24 of the Circular 04/2022/TT-BXD (takes effect from 01/01/2023) stipulating the description of dossiers on tasks in special purpose zone planning in Vietnam as follows:

2. The description includes:

a) Reasons, necessity of planning; location, scale and the boundaries of planning.

b) Overview of natural features, current status and existing problems in the process of management and development investment in the planned region. Orientations to development in national planning or regional planning; planning plan in provincial planning that has been approved and projects in progress that affect the scope of planning.

c) Identification of properties, viewpoints and objectives of planning; role of special purpose zone for the country, region and province; preliminary identification of main problems that must be handled in planning.

c) Proposal for selection of applicable economic - technical criteria, preliminary forecast about population, land and technical infrastructure within the scope of the planned region.

d) Requirements for investigation, collection of documents and data, assessment of current status; requirements for status database.

dd) Requirement for main contents of planning.

e) Identification of the list of drawings, descriptions and attached appendices; the quantity and specifications of the dossiers on projects on planning; cost estimates; plans and progress in organization of planning; identification of requirements for contents, forms and subjects subject to collection of their opinions on projects on planning.

3. Drafts of the Proposal and Decision on approval for the planning.

4. Other legal documents.

What are regulations on drawing included in dossiers on projects on general planning for construction of special purpose zones in Vietnam?

Pursuant to Clause 1 Article 25 of the Circular 04/2022/TT-BXD (takes effect from 01/01/2023) stipulating drawing included in dossiers on projects on general planning for construction of special purpose zones in Vietnam as follows:

1. The drawing includes:

a) Diagram of location and regional relationship: Location, scale and the boundaries of the planned region; relationships to nature, society-economy, urban and rural development, space organization and zoning, infrastructure development, resource use and environmental protection in the regional or provincial planning that affects the planned region. The drawing shall be shown in map of organization of space and map of zoning in regional planning or provincial planning that has been approved at an appropriate scale.

b) Map of current status: Current status of land use functions as prescribed in Appendix IV of this Circular; landscape architecture, social infrastructure system (education, health care, culture, commerce, trees, houses, ...); technical infrastructure systems (traffic, electricity supply and lighting, communications, water supply, elevation and rainwater drainage, wastewater drainage; solid waste management, cemeteries and environment) . The drawing shall be shown in the topographic map at the scale of 1/5.000 or 1/10.000.

c) Map of general assessment and selection of land according to appropriate criteria for assessment of topography, current conditions, hydrogeology; assessment of land use. Identification of favorable, less favorable and unfavorable areas for the development. Identification of prohibited and restricted areas for urban development in special purpose zone. The drawing shall be shown in the topographic map at the scale of 1/5.000 or 1/10.000.

d) Development structure diagram of the planned zone (including diagrams that analyze current status and propose options enclosed with the descriptions of criteria for consideration and selection of options); main transport system framework, linkage between main special purpose zones, central zones and the direction of expansion of special purpose zones. The drawing shall be shown in the topographic map at the scale of 1/5.000 or 1/10.000.

dd) Space development orientation map: Identification of space development structure according to special purpose zones; key areas, architecture and landscape areas, main spatial axes, system of squares, gateway areas, highlight works of special purpose areas; connection in transport and technical infrastructure among regions; areas where the underground works are expected to be built (if any).

General planning for construction of economic zones and high-tech zones: identification and demonstration of the boundaries of areas subject to intervention in control of the development including embellishment and renovation zones, conservation areas, new development areas, other landscape architecture areas that must be protected,... The drawing shall be shown in the topographic map at the scale of 1/10.000.

e) Map of land use planning according to the stages of planning: Location and scale of land use functions as prescribed in Appendix VII of this Circular; identification of population size (if any), land, land use indicators of each area in special purpose zones according to the stages of development. Main space areas of economic zones, high-tech zones, research and training zones: specify the maximum and minimum storey of buildings. The drawing shall be shown in the topographic map at the scale of 1/10.000.

g) Architecture and landscape control orientation drawings: Identification of architecture and landscape zones in the planned area; proposal for organization of space of important axes and special purpose areas (central areas, gateway areas, main space axes, squares, green spaces, water surface and highlight areas and works, etc…). The drawing shall be shown in the topographic map at the appropriate scale.

h) Technical infrastructure development orientation map: Identification of network, location and scale of technical infrastructure works at national, regional, provincial and urban levels within the scope of general planning according to each sector, including: technical preparation, traffic (down to main regional roads), water supply, energy supply, water drainage and wastewater treatment, solid waste management, cemeteries, passive telecommunications infrastructure and other technical infrastructure works. The drawing shall be shown on map of land use planning for special purpose zone according to the stages of planning in combination with topographic map at the scale of 1/10.000.
