Driving a motorcycle without license plates may result in vehicle impoundment?
Point c Clause 2 Article 17 of Decree 100/2019/ND-CP stipulates:
- A fine of VND 300,000 to VND 400,000 shall be imposed for any of the following violations:
...
c) Operating a vehicle without a license plate (for types of vehicles required to have license plates); using a license plate that does not match the Vehicle Registration Certificate or a plate not issued by a competent authority.
At the same time, Clause 1 Article 82 of this Decree also stipulates:
To immediately prevent administrative violations, the competent authority is allowed to temporarily seize the vehicle for a maximum of 7 days before the penalty decision is issued for the violations stipulated in the following articles, clauses, and points of this Decree and must comply with the provisions of Clause 2 Article 125 of the Law on Handling Administrative Violations:
...
g) Clause 2 Article 17;
...
Thus, in the case of operating a vehicle without a license plate, in addition to being fined from VND 300,000 to VND 400,000, the competent authority is allowed to temporarily seize the vehicle before issuing a penalty decision.
