Does the Chairman of the Provincial People's Committee Have the Authority to Impose Penalties in the Field of Healthcare?

According to Clause 3, Article 103 of Decree 117/2020/ND-CP stipulating the authority of the Chairman of the Provincial People's Committee to impose administrative sanctions in the field of health as follows:

- Issue a warning;

- Impose fines up to VND 30,000,000 for administrative violations in the field of population; up to VND 50,000,000 for administrative violations in the fields of preventive medicine and HIV/AIDS prevention and control; up to VND 75,000,000 for administrative violations in the field of health insurance; up to VND 100,000,000 for administrative violations in the fields of medical examination and treatment, pharmaceuticals, cosmetics, and medical equipment;

- Suspend the use of licenses, professional certificates for a certain period, or suspend operations for a certain period;

- Confiscate evidence and means used in administrative violations;

- Apply remedial measures stipulated at points c, d, dd, e, g, h, and i, Clause 1, Article 28 of the Law on Handling of Administrative Violations and Clause 3, Article 3 of this Decree.
