Does making a false statement about having a driver's license result in increased traffic violation fines?
1. Forgetting to Bring Driver’s License: A fine of 100 thousand VND to 200 thousand VND (Point c Clause 2 Article 21 Decree 100/2019/ND-CP).
(Exception for those with an international driver’s license but not carrying a national driver’s license).
2. Not Having a Driver’s License:
- A fine of 800 thousand VND to 1.2 million VND for operating a two-wheeled motorcycle with an engine capacity under 175 cm3 (Point a Clause 5 Article 21).
- A fine of 3 million VND to 4 million VND for operating a two-wheeled motorcycle with an engine capacity of 175 cm3 or above (Point b Clause 7 Article 21).
Thus, the fines for the two aforementioned actions differ. If you intentionally falsely claim to have a driver’s license, it is considered an aggravating factor (Point k Clause 1 Article 10 Law on Handling of Administrative Violations 2012).
Therefore, in addition to being fined for not having a driver’s license, your fine may increase but will not exceed the maximum fine bracket (Clause 4 Article 23 Law on Handling of Administrative Violations 2012).
