Amending the Name, Duties, and Powers of the Title with Authority to Decide on the Installation and Use of Technical and Operational Equipment?
Changes in titles, duties, authorities of positions authorized to decide on the installation and use of professional technical means and equipment?
Pursuant to Clause 3, Article 12 of Decree 135/2021/ND-CP regarding changes in titles, duties, and authorities of positions authorized to decide on the installation and use of professional technical means and equipment are regulated as follows:
- Changes in titles, duties, and authorities of positions authorized to decide on the installation and use of professional technical means and equipment:
a) In case the titles stipulated in Clause 2 of this Article are changed in terms of names but not in terms of duties and authorities, the authority to decide on the installation and use of professional technical means and equipment of these titles remains unchanged;
b) In case the titles stipulated in Clause 2 of this Article remain unchanged in terms of names but are changed in terms of duties and authorities related to the authority to decide on the installation and use of professional technical means and equipment, they no longer have the authority to decide on the installation and use of professional technical means and equipment.
Requirements and responsibilities of users of professional technical means and equipment?
Based on Article 13 of this Decree, the requirements and responsibilities of users of professional technical means and equipment are regulated as follows:
- Officers and soldiers of the People's Public Security, People's Army, specialized inspectors, officials, and public employees belonging to the forces stipulated in Clause 2, Article 9 of this Decree when using professional technical means and equipment must ensure the following requirements:
a) Thoroughly understand the management policies and use of professional technical means and equipment;
b) Be trained in the procedures, handling, and preservation of professional technical means and equipment.
- Responsibilities of users of professional technical means and equipment:
a) Follow the correct procedures and regulations, ensure safety, maintenance, and preservation of professional technical means and equipment;
b) Be legally responsible for the use of professional technical means and equipment and the outcomes collected by these means and equipment.
