Preferential Regime for Martyrs' Family Members under New Regulations?
The preferential policies for relatives of martyrs according to the new regulations specified in Article 16 of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution 2020 (effective from July 1, 2021). To be specific:
Issue “Martyr's Family Certificate” as prescribed by the Government of Vietnam.
One-time death benefit assistance when posthumously awarding the “Meritorious Service to the Fatherland” certificate; in cases where there are no relatives, the heir of the martyr holding the “Meritorious Service to the Fatherland” certificate is entitled to a one-time death benefit assistance.
Monthly death benefit assistance for the following individuals:
a) Biological father, biological mother, child of the martyr under 18 years old or 18 years old or older if still studying or having a severe disability, especially severe disability, and individuals who have cared for the martyr; in cases where there are multiple martyrs, the benefits will be according to the levels for the relatives of two martyrs, the relatives of three or more martyrs;
b) Spouse of the martyr.
In cases where the biological father, biological mother, individual who cared for the martyr, spouse of the martyr specified in Clause 3 of this Article are living alone, and the child of the martyr specified in Clause 3 of this Article is an orphan of both parents, they are entitled to additional monthly nurturing death benefit assistance.
Health recovery and rehabilitation every two years for the biological father, biological mother, individual who cared for the martyr, spouse, and severely disabled child of the martyr.
In cases where the biological father, biological mother only have one child who is a martyr or have two or more children who are martyrs, health recovery and rehabilitation are provided annually.
Health insurance for the biological father, biological mother, individual who cared for the martyr, spouse, and child of the martyr.
Preferential policies specified in points d, dd, e, g, h, i, and k Clause 2 Article 5 of this Ordinance.
Preferential policies specified in point c Clause 2 Article 5 of this Ordinance for the relatives of martyrs currently receiving monthly death benefit assistance.
Support for visiting martyr's graves and relocating martyr's remains.
The spouse of the martyr who remarries but raises the martyr's child to adulthood or takes care of the martyr's biological father or mother while alive, or due to revolutionary activities does not have the conditions to take care of the martyr's biological father or mother while alive, shall enjoy the following preferential policies:
a) Monthly death benefit assistance;
b) Health insurance.
A one-time allowance for relatives equivalent to 03 months of the current monthly benefit when the subjects specified in Clause 3 of this Article entitled to monthly benefits die, excluding the cases where the subjects specified in Clause 10 of this Article die.
Funeral allowance for the person or organization performing the funeral when the subjects specified in Clause 3 of this Article entitled to monthly benefits die, excluding the cases where the subjects specified in Clause 10 of this Article die.
