Organizing the Search and Collection of Martyrs' Remains
Pursuant to Article 142 of Decree 131/2021/ND-CP, the regulations on organizing the search and collection of martyrs' remains are as follows:
- The forces involved in the search and collection of martyrs' remains include: specialized forces, and temporary forces directly performing the task of searching and collecting martyrs' remains in and outside the country. In necessary cases, additional forces may be requisitioned for tasks such as guiding, protecting, digging, excavating, etc.
- The Ministry of National Defense shall decide on the establishment of specialized and temporary forces. The Chairman of the Provincial People's Committee or the Head of the Provincial Steering Committee for the search and collection of martyrs' remains shall decide on the requisition of forces when necessary, after obtaining unified consent from the Ministry of National Defense.
Handover of Martyrs' Remains and Samples
According to Article 143 of Decree 131/2021/ND-CP, the regulations on the handover of martyrs' remains and samples are as follows:
- For identified martyrs' remains, the collection unit is responsible for handing over the martyrs' remains to the Department of Labor, Invalids, and Social Affairs of the locality which the representative of the martyr's relatives or the person receiving worship allowance for the martyr wishes to bring the remains to.
In cases where the representative of the martyr's relatives or the person receiving worship allowance for the martyr has no desire to bring the remains back, the martyrs' remains shall be handed over to the Department of Labor, Invalids, and Social Affairs where the remains were collected or where designated to receive them.
- For unidentified martyrs' remains, the collection unit shall hand over the remains and samples along with any information related to the martyr's relatives (if available) to the Department of Labor, Invalids, and Social Affairs where the remains were collected or designated to receive them.
In cases where there are relics but no basis to confirm the martyr's information, the collection unit is responsible for reporting to the competent agency or unit of the Ministry of National Defense for verification and conclusion on the martyr's information.
- The handover record shall be prepared in accordance with Form 81 or Form 82 of Appendix I of this Decree, accompanied by collection information and any related information about the martyr and next of kin (if available).
