Kidnapping Children for Ransom: What Is the Prison Sentence?

Article 169 Criminal Code 2015, amended by Clause 33 Article 1 Law amending the Criminal Code 2017, provides for the Crime of Kidnapping for Ransom, as follows:

1. Any person who kidnaps another person as a hostage with the intent of extorting property shall be subject to a sentence of imprisonment ranging from 02 years to 07 years.

2. Committing the crime under one of the following circumstances, the offender shall be subject to a sentence of imprisonment ranging from 05 years to 12 years:

a) Organized crime;

b) Professional nature;

c) Using weapons, tools, or other dangerous methods;

d) Involving a person under 16 years of age;

Therefore, in the case of kidnapping a 07-year-old child for the purpose of extorting money from the child's parents (extortion of property), the offender shall be subject to a sentence of imprisonment ranging from 05 years to 12 years.
