Driving and Causing Accidents without Severe Harm to People: Is Prosecution Applicable?
Pursuant to Article 260 of the Criminal Code 2015, Clause 72 Article 1 of the Law amending the Criminal Code 2017 regulates the crime of violating regulations on road traffic participation, Clause 1 (the lightest penalty frame for this crime) is specified as follows:
Any person who participates in road traffic and violates road traffic safety regulations causing damage to others in one of the following cases shall be fined from 30,000,000 VND to 100,000,000 VND, sentenced to non-custodial reform for up to 3 years or imprisonment from 1 year to 5 years:
a) Causing death;
b) Causing injury or harm to the health of one person with a body injury rate of 61% or more;
c) Causing injury or harm to the health of two or more people with a total body injury rate of these people from 61% to 121%;
d) Causing property damage from 100,000,000 VND to less than 500,000,000 VND.

Accordingly, any person who participates in road traffic and violates road traffic safety regulations (such as a case of violating safety regulations causing a traffic accident) though not causing death, injury, or harm to the health of others as regulated above but causing property damage from 100,000,000 VND or more shall also be subject to criminal liability for this crime.
