What is the penalty for failing to publicly list the termination of the activities of a representative office of a foreign trader in Vietnam?
Clause 1, Article 67, Decree 98/2020/ND-CP (Effective from October 15, 2020), prescribes sanctions for violations related to the establishment and operation of representative offices of foreign merchants in Vietnam as follows:
A fine ranging from 5,000,000 VND to 10,000,000 VND shall be imposed for any of the following violations:
- Providing false information in the application dossiers for the issuance, reissuance, adjustment, or extension of the license for establishing a representative office;
- Failing to publicly announce as required when terminating the operation of a representative office.
Simultaneously, according to Clause 4, Article 4 of this Decree, this fine applies to administrative violations committed by individuals. In case administrative violations are committed by organizations, the fine shall be doubled compared to the amount imposed on individuals.
Thus, individuals who fail to publicly announce as required when terminating the operation of a representative office of a foreign merchant in Vietnam shall be fined from 5 million VND to 10 million VND, and organizations shall be fined from 10 million VND to 20 million VND.
