Penalties for Trading Goods Past the Expiration Date Stated on the Label
According to Point a Clause 1 Article 17 of Decree 98/2020/ND-CP (effective October 15, 2020) stipulating violations regarding the expiration date of goods, goods of unclear origin, and other violations as follows:
A warning or a fine from VND 300,000 to VND 500,000 shall be imposed for the following violations if the violating goods are valued at less than VND 1,000,000:
Trading goods (excluding plant protection drugs, animal feed) that have exceeded the use-by date indicated on the goods label or packaging;
Therefore, trading goods (excluding plant protection drugs, animal feed) that have exceeded the use-by date indicated on the goods label, when the value of the violating goods is less than VND 1,000,000, shall be subject to a warning or a maximum fine of VND 500,000 for individuals. In the case of organizational violations, the maximum fine is VND 1,000,000 (Clause 4 Article 4 of Decree 98/2020/ND-CP).
Additionally, the confiscated items causing harm to human health, livestock, crops, and the environment shall be destroyed and the illegal profits gained from the violation acts stipulated in this Article must be surrendered.
