No Commitment to Ensure Quality of Additives When Mixing Gasoline - What Are the Penalties?
Based on Point c Clause 1 Article 44 of Decree 99/2020/ND-CP, it is stipulated:
"Article 44. Violations of regulations on gas business by gas exporters and importers, gas producers, and gas processors
1. A fine ranging from VND 20,000,000 to VND 40,000,000 shall be imposed for any of the following violations:
…
c) Conducting gas blending without a commitment to ensure that the quality of the additives does not affect the safety of humans, animals, plants, the environment, and the quality of gas as stipulated."
Additionally, according to Article 5 of this Decree, it is stipulated: The fine levels specified in Chapters II, III, and IV of this Decree are the fine levels applicable to organizations. In case of administrative violations committed by individuals, the fine shall be half the specified fine level applicable to organizations.
Article 44 falls under Chapter IV, so the aforementioned fine levels are applicable to organizations.
Thus, according to the above regulations, in the case where a gas-producing business organization conducts gas blending without a commitment to ensuring the quality of additives as stipulated above, it shall be fined from VND 20,000,000 to VND 40,000,000.
