Summon to Participate in Online Trial
Pursuant to Article 9 of Joint Circular 05/2021/TTLT-TANDTC-VKSNDTC-BCA-BQP-BTP, the procedure for summoning participants to participate in online trials is stipulated as follows:
The court shall summon participants to take part in the trial, clearly indicating the location from which they will participate.
For participants who are summoned to attend the trial at a component bridge point, the summons must specify the requirements for attending the trial as prescribed in Article 11 of this Joint Circular.
What are the Responsibilities of the Procuracy in Organizing an Online Trial?
Pursuant to Article 6 of Joint Circular 05/2021/TTLT-TANDTC-VKSNDTC-BCA-BQP-BTP, the responsibilities of the Procuracy in organizing an online trial are stipulated as follows:
Within 03 days for cases resolved under ordinary procedures, and 01 day for cases resolved under summary procedures, from the date the court's notification as prescribed at Point c Clause 1, Point c Clause 2 Article 3 of this Joint Circular is received, the Procuracy must provide a written response regarding the holding of an online trial and resolve as follows:
In case the Procuracy agrees to hold an online trial and deems it necessary to assign someone to participate at a component bridge point, the full name of the assigned participant must be clearly stated. The assigned procurator participating at the component bridge point will assist the prosecuting procurator in exercising the prosecution and supervising the trial at the central bridge point;
In case the Procuracy does not agree to hold an online trial, the trial shall be conducted in accordance with the provisions of the Criminal Procedure Code.
