Seizure of Means of Transportation of a Commercial Legal Entity: Is it Permissible?

Based on Article 24 of Decree 44/2020/ND-CP (Effective June 1, 2020) stipulating the sequestration of commercial legal entities’ means of transport as follows:

- In case of sequestration of a commercial legal entity’s means of transport, the competent criminal enforcement agency shall request the commercial legal entity or the person managing and using such means to hand over the vehicle registration certificate, if available.

- The criminal enforcement agency has the authority to request competent agencies to prohibit the transfer, pledge, mortgage, lease, or restrict traffic concerning the sequestrated means of transport.

- The sequestration of aircraft and sea-going vessels for enforcement shall be carried out in accordance with the laws on the arrest of aircraft and sea-going vessels.

=> Thus, the criminal enforcement agency is authorized to sequestrate the commercial legal entity’s means of transport to ensure enforcement.
