Judgement on First-Instance Administrative Trial: Is it Required to Send to the Procuracy?
Based on Clause 2, Article 196 of the 2015 Administrative Procedure Law concerning the issuance and delivery of judgment extracts and judgments as follows:
Within 03 working days from the date of the conclusion of the trial, the litigants shall be provided with judgment extracts by the Court.
Within 07 days from the date of the judgment announcement, the Court shall issue and send the judgment to the litigants and the same-level Procuracy.
Thus, according to the above regulation, once the judgment has been announced and issued, it is mandatory to send it to the litigants and the same-level Procuracy. This is a mandatory regulation, not merely necessary.
