Is it possible to authorize someone else to file an appeal on one's behalf?
Based on Clause 3, Article 272 of the 2015 Civil Procedure Code stipulates:
- The appellant, who is an individual with full civil procedural capacity, can file an appeal on their own. The section containing the name and address of the appellant in the appeal letter must indicate the appellant's full name, address, phone number, fax, and email address (if any). At the end of the appeal letter, the appellant must sign or affix their fingerprint.
- The appellant as stipulated in Clause 2 of this Article, if not self-appealing, can authorize someone else to represent themselves in filing the appeal. The section containing the name and address of the appellant in the appeal letter must indicate the full name, address of the authorized representative of the appellant, the appellant who authorizes the appeal; phone number, fax, email address (if any) of the authorized appellant for the appeal and the authorization document. At the end of the appeal letter, the authorized representative must sign or affix their fingerprint.
Thus, you can authorize your younger brother to represent you in filing the appeal in case you cannot attend.
