Is Account Freezing a Coercive Measure for the Enforcement of Civil Judgments?
Article 71 of the Law on Civil Judgment Enforcement 2008 provides the following measures for enforcement coercion:
Deduction of money in accounts; recovery, and handling of money and valuable papers of the judgment debtor.
Deduction from the income of the judgment debtor.
Inventory and handling of assets of the judgment debtor, including assets held by a third party.
Exploitation of assets of the judgment debtor.
Compulsion to transfer assets and rights over assets, and papers.
Compulsion for the judgment debtor to perform or refrain from performing certain acts.
Therefore, freezing accounts is not a coercive enforcement measure. According to this Law, freezing accounts is a measure to ensure enforcement (Point a Clause 3 Article 66).
