How is the delivery of legal documents to litigants who are Vietnamese citizens abroad regulated?

According to Article 9 of the Joint Circular 01/2019/TTLT-TANDTC-BNG, the delivery of legal documents to litigants who are Vietnamese citizens abroad is regulated as follows:

  1. The representative agency delivers legal documents to the litigants using the postal service for guaranteed mail delivery.

  2. Within 5 working days from the date of the mail delivery result, the representative agency shall notify the result of execution using Form No. 01 (reverse side) issued together with this Joint Circular and send it along with the postal fee invoice and the mail delivery result to the Court by the method specified in Article 4 of this Joint Circular.

  3. In case the period of 1 month from the date of dispatch has expired without receiving the mail delivery result, the representative agency requests the postal organization to provide the reason. Within 5 working days from the date of receipt of the written reply, the representative agency shall notify the result of execution using Form No. 01 (reverse side) issued together with this Joint Circular and send it along with the postal fee invoice and the mail delivery result to the Court by the method specified in Article 4 of this Joint Circular.

According to Clause 1, Article 10 of the Joint Circular 01/2019/TTLT-TANDTC-BNG, the posting at the representative agency of legal documents for litigants abroad is regulated as follows:

  1. The representative agency shall simultaneously or alternatively post the documents publicly at its headquarters and upload the legal documents on the agency's electronic information portal according to the timeframe recorded by the Court in the request for notification of legal documents.
