Based on Point b, Clause 2, Article 7 of the Law on Judicial Expertise 2012, which stipulates as follows:
Individuals in the following cases shall not be appointed as judicial experts:
- The person is incapable of civil acts or has limited civil act capacity;
- The person is being prosecuted for criminal liability; has been convicted but has not yet had their criminal record expunged for negligent or less severe intentional crimes; has been convicted of serious crimes, very serious crimes, or especially serious intentional crimes;
Therefore, your uncle is being prosecuted for theft, which means he is being prosecuted for criminal liability. Consequently, he cannot currently be appointed as a judicial expert.
