Can a Police Officer Who Dies While Conducting an Anti-Drug Operation Be Recognized as a Martyr?
Are police officers who die during drug prevention operations recognized as martyrs?
According to Clause 5, Article 14 of Decree 131/2021/ND-CP, the conditions and standards for recognizing martyrs are stipulated as follows:
- Directly performing the task of combating crimes as stipulated in point i, clause 1, Article 14 of the Ordinance, means directly carrying out the task as required by the competent authority to investigate, detect, prevent, arrest offenders, or prevent acts dangerous to society as stipulated in the Criminal Code.
At Point i, Clause 1, Article 14 of the Ordinance on Preferences for Persons with Revolutionary Contributions 2020, the following regulation is prescribed:
Article 14. Conditions for recognizing martyrs.
- Persons who have sacrificed for the cause of revolutionary liberation, national construction and defense, international duty, or for the interests of the State and the People shall be considered for recognition as martyrs by the competent authority in the following cases:
i) Directly performing the task of combating crimes;
Based on the above grounds, police officers who die while performing a drug prevention mission may be recognized as martyrs.
Who is responsible for preparing the dossier for recognizing martyrs?
According to Article 15 of Decree 131/2021/ND-CP, the responsibilities for preparing the dossier for recognizing martyrs are stipulated as follows:
The agency, organization, or unit directly managing the person who sacrificed is responsible for preparing the dossier for recognizing martyrs.
The agency, organization, unit, or individual discovering or storing information and documents related to the person who has not been recognized as a martyr is responsible for providing them to the agency, organization, or unit stipulated in clause 1 of this Article as a basis for preparing the dossier for recognizing martyrs.
Thus, the above-listed agencies and organizations are responsible for preparing the dossier for recognizing martyrs.
