      What day does the 2024 Lunar New Year holiday start according to the law in Vietnam?

      According to Notice 5015/TB-LDTBXH 2023, the 2024 Lunar New Year holiday schedule is prescribed as follows:

      - Officials, public employees and employees working at administrative agencies, political organizations or socio-political organizations (hereinafter referred to as “officials and public employees”) are entitled to have the Lunar New Year holiday in 2024 from Thursday, February 08, 2024 of the solar calendar (i.e. December 29, 2023 of the lunar calendar) to the end of Wednesday, February 14, 2024 of the solar calendar (i.e. January 05, 2024 of the lunar calendar). This holiday includes 05 days of the Lunar New Year holiday and 02 days of compensatory time-off for the weekly days off.

      - For employees, the employer decides to choose 01 ending day of the year 2023 and 04 beginning days of the year 2024 of the lunar calendar, or 02 ending days of the year 2023 and 03 beginning days of the year 2024 of the lunar calendar, or 03 ending days of the year 2023 and 02 beginning days of the year 2024 of the lunar calendar. If the weekly day off coincides with a New Year holiday, the employee is entitled to compensate for the weekly day off on the next working day.

      What is calculation of salary for working on Lunar New Year 2024 in Vietnam?

      First, Article 112 of the 2019 Labor Code stipulates public holidays as follows:

      Public holidays

      1. Employees shall be entitled to fully paid days off on the following public holidays:

      a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

      b) Lunar New Year Holidays: 05 days;

      c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);

      d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

      dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

      e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

      2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.

      3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.

      At the same time, Article 98 of the 2019 Labor Code also stipulates overtime pay, night work pay specifically as follows:

      Overtime pay, night work pay

      1. An employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:

      a) On normal days: at least 150%;

      b) On weekly days off: at least 200%;

      c) During public holidays, paid leave, at least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.

      2. An employee who works at night will be paid an additional amount of at least 30% of the normal salary.

      3. An employee who works overtime at night will be paid, in addition to the salary specified in Clause 1 and Clause 2 of this Article, an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.

      4. The Government shall elaborate this Article.

      From the above regulations in Vietnam, it can be seen that Lunar New Year 2024, also known as Lunar New Year 2024, according to regulations, is entitled to 07 days off (including 05 days according to the 2019 Labor Code and 02 weekly compensation days).

      Therefore, if an employee goes to work on Lunar New Year 2024, their salary will be calculated as follows:

      Employees who work overtime on Lunar New Year are entitled to at least 300% of the salary, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.

      In addition, if an employee works overtime at night on Lunar New Year, in addition to being paid overtime on holidays, Tet, and night work salary, the employee will also be paid an additional 20% of salary according to the salary unit price or salary based on work done during the day on a normal working day or on a weekly day off or on a public holiday.

      At the same time, employees who work at night are paid an additional amount of at least 30% of the salary calculated based on the salary unit price or actual salary paid according to the work of a normal working day.
