    • What is the deadline for birth registration in Vietnam?

      Pursuant to Article 15 of the Law on Civil Status in 2015 stipulating birth registration responsibility as follows:

      Birth registration responsibility

      1. Within 60 days after the birth of their child, the father or mother shall register the child’s birth; if the parents are unable to register their child’s birth, the grandfather or grandmother or another relative or the individual or organization that is nurturing the child shall register his/her birth.

      2. Justice and civil status officers shall regularly examine and urge the birth registration for children in their localities within the prescribed time limit; in case of necessity, mobile birth registration may be made.

      As regulations above, within 60 days after the birth of their child, the father or mother shall register the child’s birth.

      If the parents are unable to register their child’s birth, the grandfather or grandmother or another relative or the individual or organization that is nurturing the child shall register his/her birth.

      What are regulations on documents for proof of parent-child relationship when registering birth registration in Vietnam?

      Pursuant to Article 14 of the Circular 04/2020/TT-BTP stipulating proof of parent-child relationship as follows:

      Proof of parent-child relationship

      Proof of parent-child relationship according to regulations in Clause 1 Article 25 and Clause 1 Article 44 of the Law on Civil Status includes one of the following documents:

      1. Written confirmation of the father-child or mother-child relationship from a competent domestic or foreign regulatory body, organization, health authority or testing authority.

      2. In case there is no proof of the parent-child relationship per regulations in Clause 1 herein, the parent and child shall draw up a confirmation of their parent-child relationship according to regulations in Article 5 herein with at least 2 witness of their parent-child relationship.

      As regulations above, proof of parent-child relationship includes one of the following documents:

      - Written confirmation of the father-child or mother-child relationship from a competent domestic or foreign regulatory body, organization, health authority or testing authority.

      - In case there is no proof of the parent-child relationship, the parent and child shall draw up a confirmation of their parent-child relationship with at least 2 witness of their parent-child relationship.

      Instruction for online birth registration in 2023 in Vietnam

      You can refer to the following steps to register a birth online in 2023:

      Step 1: Access the Ministry of Justice's Household Registration System at the following link:

      Step 2: Select the province or city to register a birth => Select "Continue"

      Step 3: Select "Register a new birth" for the case of registering a birth for the first time; select "Re-register a birth" for the case of having registered a birth before.

      Step 4: Select the receiving unit => Select "Continue";

      Step 5: Fill in all the required information correctly => Select "Continue";

      Step 6: Confirm the information on the file => Enter the verification code and submit the registration file.

      What violations related to birth registration are subject to administrative fines in Vietnam?

      Pursuant to Article 37 of the Decree 82/2020/NĐ-CP stipulating violations related to birth registration as follows:

      Violations of regulations on birth registration

      1. Fines of VND 1,000,000 to VND 3,000,000 for acts of erasing, correcting, or falsifying the contents of documents issued by agencies, organizations, or competent persons to conduct birth registration procedures.

      2. Fines of VND 3,000,000 to VND 5,000,000 for one of the following acts:

      a) Assessing, testifying falsely about birth;

      b) Providing false information or documents about the contents of the birth certificate;

      c) Using someone else's documents to conduct birth registration procedures.

      3. Additional penalties:

      Confiscation of evidence, such as documents or documents that have been erased, corrected, or falsified, for the violation prescribed in Clause 1 of this Article.

      4. Remedial measures:

      Recommend that the agency, organization, or competent person consider and handle the birth certificate issued due to violations prescribed in Clauses 1 and 2 of this Article; documents or documents that have been erased or corrected to falsify the contents as prescribed in Clause 1 of this Article.

      As regulations above, violations related to birth registration that are subject to administrative fines in Vietnam are:

      - Actions of erasing, correcting, or falsifying the contents of documents issued by agencies, organizations, or competent persons to conduct birth registration procedures.

      - Actions of making a false statement or testifying falsely about the birth.
