How much money is supported per hectare for forest protection under the Sustainable Forestry Development Program for the period 2021-2025 in Vietnam?

Pursuant to Clause 2 Article 3 of the Circular 21/2023/TT-BTC stipulating as follows:

Forest protection by contract

1. Subjects, criteria, and methods of forest protection by contract: Implement according to the regulations in Clause 1, Clause 2, Clause 3, Clause 4, and Clause 7 of Article 7 of Circular No. 12/2022/TT-BNNPTNT dated September 20, 2022 of the Ministry of Agriculture and Rural Development guiding some forestry activities to implement the Sustainable Forestry Development Program and the National Target Program for Socio-Economic Development of Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025 (hereinafter referred to as Circular No. 12/2022/TT-BNNPTNT of the Ministry of Agriculture and Rural Development).

2. Average support rate for forest protection by contract: VND 300,000/ha/year. For coastal forest protection by contract, the maximum support rate is 1.5 times the average support rate.

3. Budget for establishing forest protection by contract dossiers: VND 50,000/ha/5 years, implemented throughout the 2021-2025 Program period and is allocated within the total budget for forest protection by contract for units and localities implementing the Program. The support for the budget for establishing forest protection by contract dossiers is only carried out once before carrying out forest protection by contract.

Therefore, forest protection by contract under the Sustainable Forestry Development Program for the period 2021-2025 is supported as follows:

- The average support rate for forest protection by contract will be VND 300,000/ha/year.

- The maximum support rate for coastal forest protection by contract is 1.5 times the average support rate.

The forest objects for forest protection by contract include: Forests that are owned by the State and managed by the Management Board of Special-Use Forests, the Management Board of Protection Forests; Special-Use Forests, Protection Forests that are owned by the State and managed by Economic Organizations, Armed Forces units; Forests that are not yet allocated or leased and are managed by Commune People's Committees (hereinafter referred to as Commune People's Committees).

Therefore, the subjects eligible for support for forest protection by contract under the Sustainable Forestry Development Program for the period 2021-2025 include:

- Forests that are owned by the State and managed by the Management Board of Special-Use Forests, the Management Board of Protection Forests;

- Special-Use Forests, Protection Forests that are owned by the State and managed by Economic Organizations, Armed Forces units;

- Forests that are not yet allocated or leased and are managed by Commune People's Committees.

Who are the contractors for forest protection in Vietnam?

Pursuant to Clause 2 and 3, Article 7 of the Circular 12/2022/TT-BNNPTNT stipulating as follows:

2. Contracting party for forest protection:

a) Management Boards of Special-Use Forests, Management Boards of Protection Forests, and Agricultural and Forestry Companies as prescribed in Article 2, Clause 1 of Decree No. 168/2016/NĐ-CP dated December 27, 2016 of the Government on the regulation on the allocation of forests, gardens, and water areas in the management boards of special-use forests, protection forests and one-member limited liability agricultural and forestry companies owned by the State (hereinafter referred to as Decree No. 168/2016/NĐ-CP);

b) Organizations and units that are granted forests as prescribed in Clauses 2, 3, and 4, Article 8 of the Forest Law;

c) Commune People's Committees.

3. Contractor for forest protection:

a) Households, individuals who are legally residing in the locality (commune, ward, town) as prescribed in the Residence Law 2020; communities as prescribed in the Forest Law 2017 in the area where the contracting party is located;

b) Armed forces units stationed in the area, political - social organizations in the locality.

Therefore, the contracting party for forest protection includes:

- Management Boards of Special-Use Forests, Management Boards of Protection Forests, and Agricultural and Forestry Companies

- Organizations and units that are granted forests:

+ Economic organizations, including enterprises, cooperatives, federations of cooperatives, and other economic organizations established and operating in accordance with the law, except for cases of forest ownership.

+ Units of the people's armed forces that are granted forests (hereinafter referred to as armed forces units).
Scientific and technological organizations, training, and vocational education organizations in forestry.

- Commune People's Committees.
