Individuals satisfying conditions under Clause 3 Article 201 of the Law on Intellectual Property and applying for copyright, related right assessor's card shall submit application for issuance of assessor's card in person or via post service to state authorities governing copyright and related rights affiliated with the Ministry of Culture, Sports and Tourism.       a) Form No. 10 under Appendix III attached hereto;

      b) Original copies or certified true copies of written qualification of assessment examination or written approval of the examination council for exemption from assessment examination;

      Pursuant to Clause 1 Article 93 of the Decree 17/2023/NĐ-CP and Clause 3 Article 201 of the Law on Intellectual Property (amended by Clause 26 Article 1 of the Law on Amending and Supplementing the Law on Intellectual Property in 2009) stipulating conditions for issuance of copyright, related right assessor’s card in Vietnam as follows:

      - Having professional knowledge and expertise to assess and make conclusion on matters related to intellectual property rights.

      - Being a Vietnamese citizen and having full civil act capacity.

      - Permanently residing in Vietnam.

      - Possessing good ethical qualities.

      - Possessing a university or higher degree in a profession relevant to domains in which an assessor card is applied for having conducted professional activities in these domains for five or more years and passed a professional assessment examination.

      - Being recognized and granted a copyright and related rights assessor's card by a competent state agency.

      What are procedures for issuance of copyright, related right assessor’s card in Vietnam?

      Pursuant to Clause 1 and 2, Article 98 of the Decree 17/2023/NĐ-CP stipulating procedures for issuance of copyright, related right assessor’s card in Vietnam as follows:

      Step 1: Individuals shall submit application for issuance of assessor's card in person or via post service to state authorities governing copyright and related rights affiliated with the Ministry of Culture, Sports and Tourism.

      Step 2: Within 20 days from the date on which adequate application is received, state authorities governing copyright and related rights affiliated with the Ministry of Culture, Sports and Tourism shall:

      - issue decision on issuance of assessor’s card

      - respond in writing and state reasons in case of rejection
