Volunteer Youths Who Die While Performing Duties: Are They Entitled to Funeral Support?

Voluntary youth performing duties and passing away, is there funeral support? I am a Youth Union officer at a local level; although the issue I am inquiring about is not desirable, it needs to be understood to comply with the law. I respectfully request your advice. Sincerely, thank you.

Are volunteers who die while performing their duties eligible for funeral support?

According to Clause 5, Article 11 of Decree 17/2021/ND-CP regarding policies towards volunteers during their volunteer activities:

  1. Volunteers who die while performing their duties are eligible for funeral support in accordance with social insurance law. In cases where volunteers are not enrolled in social insurance, the conducting agency, organization, or unit will provide funeral support and transportation means to return the deceased to their hometown or family upon the request of relatives.

Based on current regulations, volunteers who die while performing their duties will receive funeral support in accordance with social insurance law or support from the conducting agency, organization, or unit for funeral arrangements and transportation to their hometown or family upon the request of relatives.

What policies apply if a volunteer is involved in an accident but is not enrolled in social insurance?

According to Clause 6, Article 11 of Decree 17/2021/ND-CP regarding policies towards volunteers during their volunteer activities:

  1. Volunteers who are not subject to compulsory social insurance and health insurance and have not voluntarily enrolled in social insurance and health insurance, and meet with an accident while performing volunteer duties, are eligible for the following policies from the conducting agency, organization, or unit:

a) In cases of accidents leading to a reduction in work capacity from 5% to 30%, at least half of the cost for medical treatment, health recovery, and functional rehabilitation will be supported;

b) In cases of accidents leading to a reduction in work capacity from 31% or more, in addition to the support policies mentioned in point a of this Clause, a lump sum allowance with a minimum amount of 5,000,000 VND will be provided. For every additional 1% reduction in work capacity, an additional minimum amount of 1,000,000 VND will be granted;

c) In cases of death due to a work-related accident, a lump sum allowance with a minimum amount of 50,000,000 VND will be provided.

Based on current regulations, volunteers involved in accidents while performing their duties who are not enrolled in social insurance are still eligible for certain policies depending on the circumstances.
