When shall the Certificate of inspection of road motor vehicles in Vietnam be expired?

Pursuant to Clause 7 Article 9 of the Circular 16/2021/TT-BGTVT stipulating certificate of inspection:

7. Certificate of inspection and seals of inspection expire when:

a) Motor vehicles are issued with new Certificate of inspection and seals of inspection;

b) Vehicle users have declared missing Certificate of inspection or seals of inspection with register authority;

c) Register authority have issued notice on retrieval;

d) Motor vehicles are involved in accidents to such an extent that technical safety and/or environmental protection cannot be guaranteed as per the law.

dd) Register authority has verified discrepancy between technical specifications on Certificate of inspection and actual technical specifications of motor vehicles.

As regulated above, Certificate of inspection of road motor vehicles in Vietnam will be expired in following cases:

- Motor vehicles are issued with new Certificate of inspection and seals of inspection;

- Vehicle users have declared missing Certificate of inspection or seals of inspection with register authority;

- Register authority have issued notice on retrieval;

- Motor vehicles are involved in accidents to such an extent that technical safety and/or environmental protection cannot be guaranteed as per the law.

- Register authority has verified discrepancy between technical specifications on Certificate of inspection and actual technical specifications of motor vehicles.

Pursuant to Clause 1 Article 6 of the Circular 16/2021/TT-BGTVT (amended by Clause 2 Article 1 of the Circular 2/2023/TT-BGTVT):

Necessary documents when producing vehicle dossiers and inspection documents

1. Preparation of vehicle dossiers

Vehicle users shall declare and provide the following information and documents to prepare vehicle dossiers (excluding cases of first-time inspection for issuance of Inspection Certificates and Inspection Seals with a period of validity of 15 days):

a) Documents on vehicle registration (master register of the vehicle registration certificate issued by a competent state authority or master register of the notice of receipt of the vehicle registration certificate (enclosed with copies of the vehicle registration certificate) used as collateral of a credit institution or copies of the vehicle registration certificate verified by a financial leasing company (enclosed with copies of the vehicle registration certificate)) or the appointment letter for issuance of the vehicle registration certificate

b) Copies of records of factory release quality inspection for motor vehicles manufactured and assembled domestically (except liquidated motor vehicles);

c) Master registers of certificates of technical safety and environmental protection for innovated motor vehicles in case of newly innovated vehicles;

d) Pencil tracings of vehicle identification numbers in case of vehicles eligible for exemption from inspection as prescribed in Clause 3 Article 5 of this Circular;

dd) Corresponding information as prescribed in Appendix I promulgated together with this Circular.

As regulated above, following documents are required for vehicle dossiers and inspection documents (excluding cases of first-time inspection for issuance of Inspection Certificates and Inspection Seals with a period of validity of 15 days):

- Documents on vehicle registration, or the appointment letter for issuance of the vehicle registration certificate;

- Copies of records of factory release quality inspection for motor vehicles manufactured and assembled domestically (except liquidated motor vehicles);

- Master registers of certificates of technical safety and environmental protection for innovated motor vehicles in case of newly innovated vehicles;

- Pencil tracings of vehicle identification numbers in case of vehicles eligible for exemption from inspection as prescribed by law;

- Corresponding information as prescribed in Appendix I promulgated together with the Circular 16/2021/TT-BGTVT.

What are prohibited acts in motor vehicle inspection in Vietnam?

Pursuant to Article 4 of the Circular 16/2021/TT-BGTVT stipulating prohibition in motor vehicle inspection:

- Fail to conduct inspection adequately, fail to comply with inspection procedures or regulations, fail to conduct inspection within inspection line, or fail to conduct inspection within the designated entities; falsify inspection result.

- Conduct inspection when inspecting instrument is damaged, or conduct inspection when inspecting instrument has not been examined, assessed, and calibrated.

- Conduct inspection without connecting to the internet to transmit data and inspection results; conduct inspection when surveillance camera for supervising and storing video data fails to conform to regulations and law.

- Assign inadequate personnel to conduct inspection within inspection line.

- Request vehicle users to have their vehicles repair and serviced at designated repair and service facilities.

- Charge money for inspection, fees, and charges against the law; harass or behave negatively.

- Conduct inspection and issue Certificate of inspection for motor vehicle that have expired its service life.

- Produce vehicle dossiers, conduct inspection, use inspection templates, print Certificates of inspection or seal of inspection, or submit reports on inspection results in a manner contradicting regulations and law.
