What authority has right to rename railway stations in Vietnam? Which railway lines and stations will be considered for removal in Vietnam?
The train station I am working at is about to be renamed, please tell me who has the authority to rename of the train stations, thank you very much.
1. What authority has right to rename railway stations in Vietnam?
In Clause 1, Article 5 of Decree No. 56/2018/ND-CP, there are regulations on power of and procedures for naming and renaming railway lines and stations as follows:
1. Power to name and rename railway lines and stations
a) The Minister of Transport shall decide to name and rename national railway lines and stations;
b) The People's Council of the province shall decide to name and rename urban railway lines and stations under its management;
c) Investors shall decide to name and rename dedicated urban railway lines and stations in which they invested.
Thus, according to the provisions of current law in Vietnam, the authority to change the name will belong to 03 agencies: the Minister of Transport; People's Council of the province; Investors. Each entity will have the authority to rename of a railway station differently based on the provisions of Clause 1, Article 5 of Decree 56/2018/ND-CP.
2. Which railway lines and stations will be considered for removal in Vietnam?
In Article 6 of Decree 56/2018/ND-CP, requirements for removal of railway lines and stations are as follows:
The removal of railway lines and stations shall be considered in the following cases:
1. Operation of railway lines and stations affects national defense and security secrets, national sovereignty and interests.
2. Railway lines and stations are no longer conformable to the railway line and station development planning approved by the competent authority.
Thus, according to the current law, there will be 02 cases where railway lines, sections and railway stations are considered for dismantling: the operation of railway lines and stations affects national defense and security secrets, national sovereignty and interests; railway lines and stations are no longer conformable to the railway line and station development planning approved by the competent authority in Vietnam.
