From September 1st, 2023, what documents should be included in application for extension and cancellation of license of connection of the railway line in Vietnam?

In Clause 3, Article 10 of Circular 26/2018/TT-BGTVT, as amended by Clause 3, Article 1 of Circular 11/2023/TT-BGTVT, it is stipulated that the application for extension and cancellation of license of connection of the railway line is as follows:

3. Dossier of application for extension and cancellation of connection license:

a) A dossier of application for extension of the connection construction time includes: An application form for extension of the investor, made according to the form specified in Appendix 3 of this Circular; the original or a certified copy or a copy enclosed with the original for comparison or a legally valid electronic copy (for administrative procedures in the network environment) documents: Legal documents prove the reason for requesting extension of the connection construction time according to the granted permit and the overall project progress approved by the competent authority;

b) A dossier of application for extension of time for connection to be exploited and used includes: An application form for extension of the investor, made according to the form specified in Appendix 3 of this Circular; the original or a certified copy or a copy enclosed with the original for comparison or an electronic copy with legal validity (for performing administrative procedures in the network environment) documents: Certified legal documents explain the reasons for requesting the extension of the time to exploit and use the connection according to the granted license;

c) A dossier of request for connection cancellation includes: An application for termination of connection from an organization or individual, made according to the form specified in Appendix 4 of this Circular; the original or a certified copy or a copy enclosed with the original for comparison or a legally valid electronic copy (for administrative procedures in the network environment) documents: Exam organization plan public when aborting the connection.

Thus, from September 1, 2023, the application file for extension and cancellation of license to connect urban railway lines includes the following documents:

- Dossier to request extension of connection construction time includes:

+ The investor's application for extension;

+ The original or a certified copy or a copy enclosed with the original for comparison or a legally valid electronic copy (for administrative procedures in the network environment) of the following documents:

Legal documents evidencing the reason for requesting extension of the connection construction time according to the license granted and the overall progress of the project approved by the competent authority;

- Dossier of application for extension of time to exploit and use connection includes:

+ The investor's application for extension;

+ The original or a certified copy or a copy enclosed with the original for comparison or a legally valid electronic copy (for administrative procedures in the network environment) of documents:

Legal documents evidencing reasons for requesting extension of time to exploit and use connection according to granted license;

- Dossier of request for disconnection includes:

+ An application for cancellation of connection by organizations or individuals;

+ The original or a certified copy or a copy enclosed with the original for comparison or an electronic copy with legal validity (for administrative procedures in the network environment) of documents: Organizational plan construction when disconnecting.

How many days will application for extension and cancellation of license of urban railway connection be resolved?

In Clause 5, Article 10 of Circular 26/2018/TT-BGTVT, as amended by Clause 3, Article 1 of Circular 11/2023/TT-BGTVT, there is time limit for processing application for license extension and cancellation of railway line connection as follows:

5. Time limit for processing dossiers: 05 working days from the date of receipt of complete dossiers as prescribed, the competent authority shall extend the connection. In case of non-extension, a written explanation must be clearly stated.

a) Decide on extension according to the form specified in Appendix 7 to this Circular; Each license can only be renewed once;

The extension time for connection construction shall not exceed 12 months and at the same time shall not exceed the project implementation time approved by competent authorities;

The extension period for exploitation and use of the connection shall not exceed 12 months and at the same time shall not exceed the time allowed to exploit and use the connection specified in the granted license;

b) Decide to cancel the connection according to the form specified in Appendix 8 of this Circular.

Thus, the processing of applications for license extension and cancellation of urban railway connections is within 5 working days from the date of receipt of complete dossiers as prescribed, the competent authority to extend the connection in Vietnam.

What are procedures for application for license of extension and cancellation of urban railway connection from September 1, 2023?

In Clause 4, Article 10 of Circular 26/2018/TT-BGTVT, as amended by Clause 3, Article 1 of Circular 11/2023/TT-BGTVT, there are procedures for requesting license extension and cancellation of railway connection are as follows:

4. Order of execution

Organizations, individuals, and owners of works that have been granted connection licenses and wish to extend the license or cancel the connection specified in Clauses 1 and 2 of this Article must make 1 set of application dossiers for extension license or request for abolition of connection, shall be submitted directly or via the postal system or sent on the network environment to the agency competent to issue connection license specified in Article 7 of this Circular.

a) In case of direct submission of dossiers, if the dossier components are incomplete as prescribed, the competent agencies specified in Article 7 of this Circular shall have to guide the supplement of dossiers and return results within working days;

b) In case the application is submitted by post or done via the online environment, if the application components are not complete as prescribed, within 02 working days, the competent authority specified in Article 7 of this Law shall be notified of the application. This Circular notifies in writing guiding the completion of dossiers;

c) In case of implementation in the network environment, the organization or individual wishing to issue a connection license shall compile an application file including a file containing a snapshot of the dossier and documents in accordance with regulations and implemented on the website address: https://dichvucong.mt.gov.vn.

Note: Circular 11/2023/TT-BGTVT takes effect from September 1, 2023.
