According to the provisions of the law on competition, Is the time limit for investigating cases of restraint of competition shall not exceed 01 year?

Answer:

Pursuant to Clause 1, Article 81 of the Law on Competition 2018, the time limit for investigating competition cases is as follows:

The time limit for investigation of an anti-competitive case is 9 months from the date of investigation decision; in case of complicated case, it may be extended once but not exceeding 3 months.

Thus, the time limit for investigating a competition restriction case in Vietnam is extended 01 time and the total time limit for investigation as well as extension is not more than 12 months.

Did people study information technology and become an investigator for a competition case in Vietnam ?

Can I become a competition case investigator if I graduate from a university specializing in information technology?

Answer:

According to Article 53 of the Law on Competition 2018, a competition case investigator must meet the following criteria:

- Being Vietnamese citizens, having good moral qualities, integrity and honesty.

- Being officials of the National Competition Commission.

- Obtaining at least a bachelor's degree or higher in law, economics, finance or information technology.

- Having at least 5 years of work experience in one of the domains defined in Clause 3 of this Article.

- Having been trained in investigation procedures.

According to this Article, if you graduate in information technology and meet the remaining standards as prescribed above, you can become a competition case investigator in Vietnam.

Can the parties agree on the choice of an interpreter in competition proceedings in Vietnam ?

It is known that the interpreter is a participant in the competition procedure. So can the parties agree on the choice of an interpreter?

Answer:

Pursuant to Clause 1, Article 71 of the Law on Competition 2018, it is stipulated as follows:

Interpreter is a person who is capable of translating a language other than Vietnamese into Vietnamese and vice versa in case where participants in competition legal proceedings cannot use Vietnamese. The interpreter may be requested by Competition Investigation Agency, the anti-competitive settlement council or selected by the complainant, investigated party or person with relevant rights and obligations or agreed upon by involved parties with approval of the Competition Investigation Agency or the anti-competitive settlement council.

Thus, interpreters participating in competition procedures in Vietnam may be agreed by the parties. However, the selection of interpreters must be approved by the Competition Case Investigation Agency and the Competition Restriction Case Handling Council.
