Who is exempt from the membership fee of the Bar Association in Vietnam?

Pursuant to Article 5 of Resolution 05/NQ-HĐLSTQ in 2022 stipulating the exemption and reduction of membership fees as follows:

Exemption and reduction of membership fees

1. Lawyers who are over the age of 75 are exempt from membership fees.

2. Lawyers who are unable to practice law due to health problems, have medical records, and have a request for exemption or reduction of membership fees may be considered for exemption or reduction of membership fees from the Vietnam Bar Federation and the Bar Association.

3. The Executive Committee of the Bar Association receives applications for exemption or reduction of membership fees, considers each specific case to decide on exemption or reduction of membership fees of the Bar Association, and proposes to the Standing Committee of the Vietnam Bar Federation for approval for membership fees of the Vietnam Bar Federation.

As regulations above, lawyers who are over the age of 75 are exempt from membership fees.

Pursuant to Article 2 of Resolution 05/NQ-HĐLSTQ in 2022 stipulating the current membership fee of the Bar Association in Vietnam as follows:

Membership fees

1. Lawyers must pay membership fees to the Vietnam Bar Federation and membership fees to the Bar Association in accordance with the regulations of the Vietnam Bar Federation Charter.

The fee for membership of the Vietnam Bar Federation is 100,000 VND/person/month (one hundred thousand VND/person/month).

The fee for membership of the Bar Association is 150,000 VND/person/month (one hundred fifty thousand VND/person/month).

In which cases are lawyers refused to withdraw from the list of lawyers of the Bar Association?

Pursuant to Article 32 of the Charter of the Vietnam Bar Federation issued together with Decision 856/QĐ-TTg in 2022, the regulations on withdrawal from the list of lawyers of the Bar Association and transfer of the Bar Association are as follows:

Withdrawal from the list of lawyers of the Bar Association, transfer of the Bar Association

1. When necessary, a lawyer may apply to withdraw from the list of lawyers of the Bar Association. The application must include the reason for withdrawal. Within 5 working days from the date of receipt of the application, the Executive Committee of the Bar Association shall issue a decision to delete the lawyer's name from the list of lawyers of the Bar Association, except in the cases provided for in Clause 2 of this Article.

Within 5 working days from the date of the decision to delete the name, the Executive Committee of the Bar Association shall send the decision to delete the name of the lawyer to the Vietnam Bar Federation.

2. A lawyer shall be refused to withdraw from the list of lawyers of the Bar Association if he/she falls under any of the following cases:

a) Is in the process of being considered for disciplinary action;

b) Is in the process of serving a disciplinary sanction of suspension of membership of the Bar Association; is within 6 months from the date of the effective date of the disciplinary decision in the form of a warning;

c) Is in the process of resolving disputes with customers, lawyers or law firms;

d) Is in the process of resolving complaints or denunciations related to the practice of law;

dd) Has violated the obligation to pay membership fees to the Vietnam Bar Federation and membership fees to the Bar Association.

As regulations above, a lawyer shall be refused to withdraw from the list of lawyers of the Bar Association if he/she falls under any of the following cases:

(1) Is in the process of being considered for disciplinary action;
