Regulations on the Service of Documents, Files, and Materials of the Court, People's Procuracy, and Civil Judgment Enforcement Agency
Based on Article 33 of Decree 08/2020/ND-CP (Effective from February 24, 2020), regulating the service of documents, files, and materials of the Courts, People's Procuracies, and Civil Judgment Enforcement Agencies, as follows:
- Enforcers may serve papers, files, and documents of the Court, People's Procuracy in resolving civil cases, administrative cases, civil matters in criminal cases, and complaints and denunciations; serve papers, files, and documents of the Civil Judgment Enforcement Agency within the provincial area where the Enforcement Office is headquartered according to the service delivery contract signed between the Enforcement Office and the Court, People's Procuracy, Civil Judgment Enforcement Agency.
- If delivering outside the provincial area or in island districts outside the county area where the Enforcement Office is headquartered, the Enforcement Office can negotiate with the Court, People's Procuracy, Civil Judgment Enforcement Agency by a separate contract for each specific matter.
- The procedure for delivering the Court's, People's Procuracy's documents, files, and materials is implemented in accordance with procedural law; the procedure for delivering the Civil Judgment Enforcement Agency’s documents, files, and materials is implemented according to civil judgment enforcement law.
- The delivery service contract is performed by the method where the Court, People's Procuracy, Civil Judgment Enforcement Agency needs to transfer the types of agreed-upon documents, files, and materials to the Enforcement Office for delivery.
- The documents, files, and materials agreed to be delivered include: notices, summons, invitations, notifications, decisions to bring the case to trial, judgments, decisions, protest decisions of the Court; notifications, protest decisions of the People’s Procuracy; enforcement decisions, notices, summons, notifications of the Civil Judgment Enforcement Agency. If necessary, Enforcers may deliver other types of documents, files, and materials upon request from the Court, People's Procuracy, Civil Judgment Enforcement Agency.
- The quantity and type of specific documents, files, and materials delivered to the Enforcers are executed through a record confirmed by both parties per day.
- The main contents of the delivery service contract include: Type of documents, files, materials to be delivered; contract performance time; delivery procedure; the rights and obligations of the parties; delivery cost.
- After signing, the delivery service contract is sent to the State Treasury where the Court, People's Procuracy, Civil Judgment Enforcement Agency opened an account to control the payment of costs for the Enforcement Office.
- Each Court, People's Procuracy, Civil Judgment Enforcement Agency may sign delivery service contracts with one or more Enforcement Offices.
